(A) Pursuant to an election, September 13, 2022 the City Council of Newton, Iowa, in the County of Jasper, Iowa; shall be the governing body of the Newton Waterworks Utility.
(B) The administrative management of the Waterworks Utility shall be under the direction of the City Administrator.
(C) The operations management of the Waterworks Utility shall be under the direction of the Public Works Director, who shall function as its Director. In that capacity, the Director or the Director’s designee shall supervise the day-to-day operation of the Waterworks Utility, shall enforce this chapter and the provisions of all ordinances and regulations adopted by the City Council and shall carry out the policy directives of the City Council acting in its role as governing body of the Waterworks Utility.
(D) The Waterworks Utility shall have the following powers, duties and responsibilities:
(1) Prepare ordinances as needed to implement this chapter and place them for consideration and adoption by the City Council, and adopt such regulations and procedures as are required to implement this chapter and carry out its duties and responsibilities.
(2) Administer the acquisition, design, construction, maintenance and operation of the Water Utility system, including capital improvements.
(3) Administer and enforce this chapter and all ordinances, regulations and procedures related to design, construction, maintenance, operation and alteration of the Water Utility system, including, but not limited to the quantity and quality of the Water Utility.
(4) Inspect private water systems as necessary to determine the compliance of such systems with this chapter and any ordinances or regulations adopted by this chapter.
(5) Review plans, approve or deny, inspect and accept extensions to the water system.
(6) Annually analyze the cost of services and benefits provided, and the system and structure of fees, charges, fines, and other revenues of the Water Utility, and to make recommendations regarding adjustment to such fees, charges, fines and other revenues.
(7) Prepare and file an annual operating budget for the Water Utility and make recommendations regarding the financing of the cost of extending and replacing portions of the water system.
(8) Acquire, construct, lease, own, operate, maintain, extend, expand, replace, clean, repair, conduct, manage, and finance such facilities, operations, and activities, as are deemed by the city to be proper and reasonably necessary for a water system. These facilities may include, but are not limited to, wells, pumps, water treatment plant, maintenance buildings, transmission mains, watertowers, distribution mains and such other facilities relating to municipal Water Utility system.
