Any property, lot, parcel of land, building or premises that is a tributary directly or indirectly to the stormwater system of the city, shall be subject to a fee based upon the quantity of impervious area situated thereon. This charge is not related to the water and/or sewer service and does not rely on occupancy of the premises to be in effect. All properties having impervious area within the City of Newton will be assigned an equivalent residential unit (ERU) or a multiple thereof, as calculated in this section, with all properties having any impervious area receiving at least one ERU, which shall be considered the base rate.
(A) Residential and multi-family residential property. Single-family residential property. The stormwater utility charge for single-family properties shall be 100% of one ERU rate per month.
(B) Multi-family properties. The stormwater utility charge for all multi-family residential units shall be one ERU times the number of residential units for the first 20 units, plus 50% ERU rate for each unit after the first 20 units until a maximum cap of 60 units is met. For instance, the stormwater utility charge for a two-family residential property shall be two times the ERU rate per month, the stormwater utility charge for three-family residential properties shall be three times the ERU rate per month and the stormwater utility charge for an 80 unit multi-family residential property shall be 20 at 100% ERU value, remaining 40 to reach the maximum cap of 60 units at 50% ERU value rate per month.
(C) Agricultural property. The stormwater utility charge for agricultural properties shall be calculated as follows: Impervious surface shall be measured to determine the square feet, then divided by the ERU equivalent of (4,000 square feet), rounded to the nearest whole number to determine number of ERU. The property will be billed at 100% of the ERU rate for the first 20 ERUs, plus 50% ERU rate for each ERU after the first 20 ERUs until a maximum cap is met of 60 ERU.
(D) Commercial property. The stormwater utility charge for commercial properties, or a structure containing both residential and commercial uses, shall be calculated as follows: Impervious surface shall be measured to determine the square feet, then divided by the ERU equivalent of (4,000 square feet), rounded to the nearest whole number to determine number of ERU. The property will be billed at 100% of the ERU rate for the first 20 ERUs, plus 50% ERU rate for each ERU after the first 20 ERUs until a maximum cap is met of 60 ERU.
(E) Exempt property. The stormwater utility charge for exempt properties shall be calculated as follows: Impervious surface shall be measured to determine the square feet, then divided by the ERU equivalent of (4,000 square feet), rounded to the nearest whole number to determine number of ERU. The property will be billed at 100% of the ERU rate for the first 20 ERUs, plus 50% ERU rate for each ERU after the first 20 ERUs until a maximum cap is met of 60 ERU.
(F) Industrial property. The stormwater utility charge for industrial properties shall be calculated as follows: Impervious surface shall be measured to determine the square feet, then divided by the ERU equivalent of (4,000 square feet), rounded to the nearest whole number to determine number of ERU. The property will be billed at 100% of the ERU rate up to the maximum cap of 750 ERUs.
