§ 53.05 POWERS OF THE UTILITY MANAGEMENT AND DRAINAGE SYSTEM.
   The Stormwater Management Utility shall have the following powers, duties and responsibilities:
   (A)   Prepare ordinances as needed to implement this chapter and place them for consideration and adoption by the City Council, and adopt such regulations and procedures as are required to implement this chapter and carry out its duties and responsibilities.
   (B)   Administer the acquisition, design, construction, maintenance and operation of the utility system, including capital improvements.
   (C)   Administer and enforce this chapter and all ordinances, regulations and procedures related to design, construction, maintenance, operation and alteration of the utility system, including, but not limited to the quantity, quality and/or velocity of the stormwater conveyed hereby.
   (D)   Inspect private systems as necessary to determine the compliance of such systems with this chapter and any ordinances or regulations adopted by this chapter.
   (E)   Review plans, approve or deny, inspect and accept extensions to the stormwater drainage system.
   (F)   Annually analyze the cost of services and benefits provided, and the system and structure of fees, charges, fines, and other revenues of the utility, and to make recommendations regarding adjustment to such fees, charges, fines and other revenues.
   (G)   Prepare and file an annual operating budget for the utility and make recommendations regarding the financing of the cost of extending and replacing portions of the system.
   (H)   Acquire, construct, lease, own, operate, maintain, extend, expand, replace, clean, dredge, repair, conduct, manage, and finance such facilities, operations, and activities, as are deemed by the city to be proper and reasonably necessary for a system of storm and surface water management. These facilities may include, but are not limited to, surface and underground drainage facilities, storm sewers, watercourses, ponds, ditches, and such other facilities relating to collection, runoff, treatment and retention as will support a stormwater management system.
