§ 154.214 NOISE AND EMISSION STANDARDS.
   (A)   Noise. The incorporation of ambient noise suppression measures is required and/or it is required to place the equipment in locations less likely to impact adjacent residences or businesses to ensure compliance with all applicable noise regulations. The maximum allowable noise emitted by the small wireless facility shall not exceed 30 dBA and 40 dBC measured at a distance of three feet from any portion of the facility. The only exception is during emergencies or periodic routine maintenance where the noise standards may be exceeded temporarily.
   (B)   Emissions. The Federal Telecommunications Act of 1996 gives the FCC sole jurisdiction to regulate radio frequency emissions. Facilities that meet the FCC standards shall not be conditioned or denied on the basis of emissions impacts. Applicants for tower sites shall be required to provide information on the projected power density of the facility and how this meets the FCC standards.
