§ 154.212 RELOCATION.
At any time, subsequent to installation of small wireless facilities and related equipment or poles, the owner, or their successor in interest shall, at its own expense, modify, relocate or remove such small wireless facilities and related equipment as may become necessary, in the city's sole discretion to accommodate any maintenance, public improvement project or reconstruction of city property, infrastructure, utilities or equipment to conform to, and accommodate, such undertaking by the city. The owner shall complete the relocation, modification and/or removal necessary to accommodate the completion of any such project by the city no later than 60 days after written notice by the city, or at the time specified in the notice, whichever is last to occur. Failure to bring a small wireless facility into compliance shall constitute grounds for removal at the owner's expense and the city may remove or cause the removal of such facility at the owner's expense.
