§ 154.200 ANTENNAS, TOWERS AND SMALL WIRELESS FACILITY RIGHT-OF-WAY SITING PURPOSE.
   This code section has been established to define the general requirements for the installation of small wireless facilities within the rights-of-way in the city. This chapter is not intended to prohibit or effectively prohibit any wireless telecommunications service provider's ability to provide wireless services; prohibit or effectively prohibit any entity's ability to provide any interstate or intrastate telecommunications service; unreasonably discriminate among providers of functionally equivalent services; deny any request for authorization to place, construct or modify wireless telecommunications service facilities on the basis of environmental effects of radio frequency emissions so long as such wireless facilities comply with the FCC's regulations concerning such emissions; prohibit any collocation or modification that the city may not deny under federal or state law; or otherwise authorize the city to preempt any applicable federal or state law.
