§ 50.066 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CITY. The City of Newton.
   COLLECTION. The transportation of municipal waste from the place it is generated and includes all activities up to the time the waste is delivered to a recycling facility or solid waste disposal site.
   COLLECTOR. A person or company which collects, transports and disposes of municipal waste or recyclable materials.
   COMMINGLED. Source separated, non-putrescible recyclable materials that have been mixed at the source of generation (i.e., placed in the same container).
   CONDOMINIUM. An apartment building or housing area in which the dwelling units are owned individually.
   DESIGNATED RECYCLABLE MATERIAL. As defined in the city’s curbside recycling contract.
   DWELLING UNIT. A group of rooms located within a structure and forming a single habitable unit with facilities which are used or intended to be used for living, sleeping, cooking and eating for the exclusive use of the occupants thereof.
   MULTI-FAMILY DWELLING. Any building under one roof which contains five or more complete dwelling units or any building receiving trash collection from a dumpster or similar receptacle.
   MUNICIPAL WASTE. Any garbage, refuse, industrial lunchroom or office waste, and other material, including solid, liquid, semi-solid or contained gaseous material resulting from the operation of multi-family dwellings.
   NEARBY. Adjoining, adjacent or contiguous.
   NON-RECYCLABLE MATERIAL. Any material not defined as “recyclable material”.
   PERSON. Any individual, partnership, corporation, association institution, cooperative enterprises or any other legal entity whatsoever which is recognized by law as being subject to such rights and duties.
   PREMISES. Real property on which any multi-family dwelling unit or combination of units sharing common driveways are located.
   RECYCLING FACILITY. Any facility employing a technology that is a process that separates or recovers reusable materials that can be sold or reused by a manufacturer as substitute for or a supplement to virgin raw materials.
   RECYCLING. The separation, collection, processing, recovering and sale or reuse of materials which would otherwise be disposed of as municipal waste.
   SOURCE SEPARATION. The separation of recyclable materials from the municipal waste stream at the point of waste generation.
