(A) Title. Pursuant to the authority of Iowa Code § 380.10, the International Property Maintenance Code, 2015 Edition is hereby adopted by reference as the Property Maintenance Code for the purpose of providing rules and regulations for the minimum requirements and standards for all residential and nonresidential structures within the city to safeguard life or limb, health, property, and public welfare.
(B) Copies on file. Official copies of said codes, including amendments as adopted, or on file in the Office of Community Development.
(C) Available for public inspection. Copies of said code shall be kept available at the Office of Community Development for public inspection.
(D) Conflicts and/or duplications. Provisions in the Property Maintenance Code shall be deemed to repeal or invalidate by implication any provision of the ordinances of the city, as amended, and where other ordinances of the city shall in any way duplicate or conflict with the provisions of the Property Maintenance Code adopted under the terms of this section, the more strict provisions shall prevail.
(E) Amendments.
(1) Delete Section 108, Section 109, Section 110. Note: Refer to adopted Uniform Code for the Abatement of Dangerous Buildings.
(2) Delete Section 111.2 and replace with the following language: The board of appeals shall be the Building Trades Board as established by Newton City Code.
(3) Section 302.4 Weeds. Insert six (6) inches.
(4) Section 304.2 Protective Treatment. Amend third sentence as follows: “Peeling, flaking, and chipped paint, when it occurs on more than 50% of the exterior surfaces for the entire structure, shall be eliminated and surfaces repainted.”
(5) Section 304.2 Protective Treatment. Delete last two sentences.
(6) Section 304.6 Exterior Walls. Delete and replace as follows: “Exterior walls shall be free from holes, breaks, and loose, missing, or rotted materials; and maintained weatherproof and properly surface coated or covered with a material manufactured as an exterior siding product where required to prevent deterioration.”
(7) Chapter 4 Light, Ventilation and Occupancy Limitations. Delete all references to International Building Code and replace with City of Newton Adopted Building Code.
(8) Chapter 5 Plumbing Facilities and Fixture Requirements. Delete all references to International Plumbing Code and replace with City of Newton Adopted Plumbing Code.
(9) Chapter 6 Mechanical and Electrical Requirements. Delete all references to International Building Code and replace with City of Newton Adopted Building Code. Delete all references to International Plumbing Code and replace with City of Newton Adopted Plumbing Code.
(10) Fire Safety Requirements. Delete all references to International Building Code and replace with City of Newton Adopted Building Code. Delete all references to International Fire Code and replace with City of Newton Adopted Fire Code.
