§ 95.09 VETERAN’S PLOT.
   (A)   “Veteran” defined. The term VETERAN, as used in this section, shall be the same as defines those individuals who are eligible for a grave marker as set forth in Iowa Code § 35B.16, and as such section is from time to time amended.
   (B)   Proof of eligibility for burial. No lot in the veteran’s plot shall be deeded or conveyed, or permission given for the burial of any person therein, unless the eligibility of such persons for burial therein is first established to the satisfaction of the Community Services Manager or designee. Funeral homes shall provide to the Community Services Manager, when requested, all paperwork or documents related to said proof of eligibility.
   (C)   Time of sale of lots in all platted Veteran’s Blocks. No lot shall be granted or sold until it is required for the immediate burial of a veteran; except that, the spouse of such person may at the time of such burial or at any time thereafter that such lot is available, purchase the immediately adjoining lot for the burial of the surviving spouse of such veteran. Only one casketed or cremation remains burial shall be allowed per lot in all platted Veteran’s Sections.
   (D)   Grave markers in all platted Veteran’s Blocks. Each grave shall be marked with one government issue, flat, gray granite veteran’s marker two feet long, one foot wide and not less than four, nor more than six, inches thick, or a like marker obtained from other sources, which shall be set so that the tip is flush with the surface of the ground. No lettering shall be permitted on such markers, except the name of the person, military rank, if any, the year of birth and the year of death. No raised lettering shall be permitted. Lettering on markers which are not obtained from the government shall be like that on government issue markers. The grave of each person, whether a veteran or the spouse of a veteran, shall be marked with a separate marker. No other marker of any kind shall be allowed or used; except that, the grave of each veteran may also be marked by one or more standard bronze combination veteran’s grave marker and flag holder which can be readily removed while mowing or caring for the lot. No double marker of any kind or additional marker shall be permitted for any single burial lot.
   (E)   Objects on lot. No other markers, shrubs, trees, plants other than annual plants or cut flowers, urns or other objects of any kind, except the corner markers placed on the lots by cemetery personnel and small vases for temporary display of cut flowers, shall be permitted at any time. All cut flowers and containers, if any, shall be removed as soon as such flowers wither or fade.
   (F)   Consent to be bound by rules and regulations. The burial of any person in the veteran’s plot, or the reservation or purchase of any lot therein, shall constitute a consent by all persons concerned to be bound by and an agreement to abide by these rules and regulations.
   (G)   Applicability of general cemetery rules and regulations. The rules and regulations contained in this section are supplementary to the rules and regulations governing city cemeteries generally and are not intended to abrogate or impair restrictions and regulations imposed by such regulations which are applicable to the entire Newton Union Cemetery, except insofar as such general rules and regulations would permit anything prohibited by these rules for the veteran’s plot.
