§ 51.02 WATER CONSERVATION.
   (A)   Water conservation is important and will be observed at all times through the enforcement of a ban on the use of water outside of any residence, business, or structure outside of the permitted days or hours. Normal use of outside water will be at Level One. When the Utilities General Manager determines that a shortage of water supply threatens the city, the Utilities General Manager may, with the approval of the Mayor, raise the restriction to Level Two or Three dependent upon the availability of water. A notice containing the provisions of the upgraded level shall be delivered to each property owner within the city limits and posted in the official newspaper, on the city's website and at City Hall.
   (B)   Level One. Residents whose house number ends in an odd number shall water lawns when necessary only on odd-numbered calendar days, and those with even-numbered addresses shall water lawns on even-numbered days. On those days, properties shall not water between the hours of 10:00 a.m. and 5:00 p.m.
   (C)   Exceptions. The use of outside water will be permitted for the watering of shrubs, flowers, plants, and new sod or seed planted within the previous 30 days. The use of outside water is permitted for the cleaning of vehicles and any other use needed specifically for sanitary purposes. Reasonable recreational use of outside water will be permitted. The Fire Department is exempt from these restrictions when used in the performance of their duties for the city.
   (D)   Level Two. The use of outside water is permitted as listed above, except the permitted days and hours of use shall be set by the Utilities General Manager. No recreational use of outside water will be permitted.
   (E)   Level Three. A total ban of the use of all outside water within the city. No recreational use of outside water will be permitted. The exceptions listed in Level One will be permitted.
   (F)   Enforcement and citations. City staff shall enforce this section and are authorized to issue penalty citations to violators. Municipal water customers who have been notified of the said restrictions and who violate the watering ban shall be fined $50 on the first day and $100 each additional day. The penalty shall be added to the property owner's city water bill. The penalty amount will be set annually with the city's fee schedule.
