(A) Appointing authority. All city board and commission appointments authorized by Minnesota statutes, city ordinance or resolution shall be made by the Mayor, and such appointments shall be confirmed by the City Council.
(B) Appointment procedure. All applicants for board and commission appointments shall complete an application form and may be selected to be interviewed by the Mayor and City Council. Any appointment shall not be made until there has been a publication in the newspaper or as otherwise required by the City Council opening up the appointment to applicants, and the applicants have been interviewed.
(C) Term of appointment. Unless otherwise stated differently in this chapter, new appointees shall assume office on June 1 and shall serve until May 31; provided however, that all appointees to boards and commissions shall hold office until a successor is appointed and deemed qualified. All vacancies shall be filled in the same manner as for an expired term, but the appointment shall be for the unexpired term. The terms of office for any City Council member serving as a board or commission member shall coincide with their term of office as a member of the City Council.
(D) Employment by the city. No appointed board or commission member shall be an employee of the city except those who are members of the board or commission by virtue of their position with the city.
(E) City Administrator. The City Administrator shall be a non-voting ex officio member of all boards and commissions. If the City Administrator is unable to attend the board or commission meeting or act in the capacity of such membership, the City Administrator may authorize another city employee to serve in that capacity.
(F) Residency. All members of any board or commission that are appointed for terms beginning on or after June 1, 2012 shall be at the date of appointment and at all times during the term of appointment, a resident of the city.
(G) Remuneration. All appointed board and commission members shall serve without remuneration, but may be reimbursed by the city for out of pocket expenses incurred in the performance of their duties when such expenses have been authorized by the City Council prior to being incurred.
(H) Removal. If a commission or board member misses three meetings within a year without being excused prior to the meeting, such member may be removed therefrom any time during or at the end of the appointive year. Any board or commission member may be removed by the City Council for misfeasance, malfeasance, nonfeasance, or without cause by a majority vote of the City Council. The removed person’s position may be filled as in the case of any other vacancy. The removal process shall be without a hearing, and it shall not be necessary that the City Council establish cause for removal. This paragraph (H) does not apply to the removal of an Economic Development Authority commissioner, as the removal process shall instead be conduct pursuant to Minnesota statutes.
