§ 113.12 PROGRAMMING AND PUBLIC BENEFIT SERVICES.
   (A)   The franchisee shall make available a minimum of one access channel. The franchisee shall, to the extent of the cable system’s available channel capacity, provide to each of the subscribers who receive some or all of the services offered on the system, reception on at least one specially designated access channel. This specially designated access channel may be used by local educational authorities and local government on a first-come, first served, nondiscriminatory basis if the demand for that time arises.
   (B)   During those hours that the specially designated access channel is not being used by the local educational authorities or local government, the franchisee shall lease time to commercial or noncommercial users on a first-come, first-served nondiscriminatory basis if the demand for that time arises. The franchisee may also use this specially designated access channel for local origination or other programming during those hours when the channel is not in use by local educational authorities, local government, or commercial or non-commercial users who have leased time. The franchisee shall establish rules for the administration of the specially designated access channel. This section shall not apply to subscribers receiving only non-video services, only alarm services, or only data transmission services for computer functions.
   (C)   The franchisee shall provide, free of charge, one drop and converter if needed to each city owned building and public school within 200 feet of franchisee’s cable plant. The franchisee shall also provide no-cost basic service and the cable programming services tier to each city owned building and public school served. Any internal wiring and additional outlets requested by the city or public school for these buildings will be paid for by the city or school. Installation of a cable drop to any city or public school beyond 200 feet from franchisee’s cable plant that the city or public school wishes to have served with cable service will be paid for on a time and materials basis by the city or public school, but the basic and cable programming service tiers for the building shall be free of charge the same as if the building were located within 200 feet of franchisee’s cable plant.
