(A) The construction of any public sidewalk along any street or, the constructing, opening, curbing or paving of any street requiring the consent of the City as outlined in Chapter 93, Streets and Sidewalks, shall be accomplished to the extent possible so as to preserve any trees, shrubs or other vegetation adjacent thereto, consistent with the appropriate and practical construction aspects of the public improvement.
(B) The City Arborist shall be consulted regarding how the work may be accomplished in order to prevent injury to any tree, shrub or other vegetation. The City Arborist shall also make recommendations as to the location for installation of trees, shrubs or other vegetation, tree wells and green spaces within the public rights-of-way in order to enhance their appearance and contribute to the residents' quality of life.
(C) Upon recommendation of the City Arborist, the City may install tree wells and create tree lawns and provide and plant trees, shrubs or other vegetation therein at no cost to the property owner.
(D) Nothing herein shall be construed to prohibit or impede the construction, maintenance or operation of any public improvement or utility.
