4-5-1: CONSTRUCTION; GENERAL REQUIREMENTS:
Residents of the City shall be allowed to construct fences in front yards, provided those fences conform to the requirements of this Code.
   (A)   Wire fences shall not be constructed of barbed wire, woven wire, hog wire, chicken wire, mesh wire, electric fencing wire, or any single wire or woven wire pattern which is not generally recognized by community standards as being residential front-yard fencing.
   (B)   Fences shall not be constructed of plastic, wood or metal panelling, or of any material which is not generally recognized by community standards as being residential fencing material. (Ord. 133, 7-2-1979, eff. 7-12-1979)
   (C)   Metal chainlink or woven wire fencing shall be allowed, provided such fencing:
      1.   Is not over four feet (4') in height;
      2.   Does not cross a sidewalk or a City easement;
      3.   Does not interfere with automobile operator's visibility along a public street;
      4.   Does not create a blind spot at the intersection of a private drive and a public street;
      5.   Does not interfere with visibility at the intersection of public roadways;
      6.   Is no smaller than eleven and one-half (111/2) gauge, but no larger than nine (9) gauge wire. (Ord. 228, 2-18-1997)
   (D)   Wooden fencing shall be allowed, provided such fencing:
      1.   Is recognized in the community as material which is generally used for privacy or decorative fencing;
      2.   Does not exceed three feet (3') in height;
      3.   Does not cross a sidewalk or City easement;
      4.   Does not interfere with automobile operator's visibility along a public street;
      5.   Does not interfere with visibility at the intersection of a private drive and a public roadway;
      6.   Does not interfere with visibility at the intersection of public roadways.
   (E)   All fences permitted by this Chapter shall be kept in good order and repair and shall not be allowed to become run-down or in such a state of disrepair as to constitute a private or public nuisance.
   (F)   All fences permitted by this Chapter shall be kept free of tall weeds and grasses.
   (G)   No fence permitted by this Chapter and constructed after its adoption shall be used as evidence to establish a boundary line, unless said fence was placed upon a boundary line designated by a licensed surveyor of the State of Idaho, after a survey has been conducted and the boundary line established thereby.
