9-10-7: PROHIBITED ACTIVITIES:
   (A)   Motor Vehicles: No cars, four-wheelers, three-wheelers, motorcycles or motor vehicles of any kind shall be driven or parked upon the sidewalks or within the boundaries of any park in the City, except in those areas which have been surfaced for vehicular traffic or which have been designated by the City for motorized transportation. This rule shall not prohibit the use of ADA compliant wheelchairs that are motorized and other similar accessibility enhancing devices by disabled individuals or park maintenance vehicles. Exception would be special event permit approved by the City Council.
   (B)   Alcoholic Beverages:
      1.   Alcoholic beverages other than beer and wine are prohibited. Consumption of alcoholic beverages including beer and wine are prohibited in the following areas:
         (a)   Any public street, alley, sidewalk, parking lot, restroom, pathway and within twenty five feet (25') of playground or skate park.
      2.   It shall be unlawful to bring upon, to possess or consume in a park the contents of a container of an alcoholic beverage that contains or has capacity of two (2) or more gallons.
      3.   No sales of beer and/or wine shall be conducted except with permits associated with a special event permit approved by the City Council.
   (C)   Drugs:
      1.   No person shall commit any of the following acts in a park:
         (a)   Sell, distribute, make available or offer to provide a controlled substance or prescription drug to another.
         (b)   Package, possess or store a controlled substance.
         (c)   Transport a controlled substance or materials intended to be used in the packaging of a controlled substance.
         (d)   Solicit another to provide, make available, sell or distribute a controlled substance or prescription drug to any person.
      2.   Nothing in this section shall prohibit the possession of medications prescribed to the person or to a person under that person's care, if and under such conditions as possession of such substance is otherwise lawful.
   (D)   Sale Of Food Or Goods: No person shall sell any goods, food or food products of any kind in any park except when associated with a special event permit approved by the City Council.
   (E)   Camping: No person shall camp, lodge, make a fire or pitch a tent, lean to, tarpaulin or any other type of camping equipment in parks.
   (F)   Use Of Certain Devices Or Equipment:
      1.   No person shall putt, drive, strike, throw or otherwise propel a golf ball in any park area in the City.
      2.   The use of firearms and/or fireworks shall be and is hereby prohibited in parks.
      3.   No person shall play any games or activities involving thrown, or otherwise propelled, injurious objects such as stones, arrows, javelins or spears.
      4.   No person shall use any slingshot, javelin, shotput, discus, golf equipment or archery equipment, or any device capable of launching a projectile, in or upon in any park, except in areas specifically designated or provided for that particular use.
   (G)   Glass Containers: It is prohibited for any person to throw, carry or have in their possession any glass beverage container on park grounds.
   (H)   Advertising Or Signage In Parks:
      1.   No person shall paste, glue, tack or otherwise post any signs, plaques, advertisements or inscriptions whatsoever in any park, including adjacent rights-of-way (sidewalks, parking lots, etc.).
      2.   Plaques, tablets or signs, of a size, design and location approved by the Public Works Supervisor recognizing or acknowledging donations or contributions to any park or to facilities therein may be exempt.
   (I)   Destruction Of Park Property:
      1.   No person shall mark, deface, disfigure, injure, tamper with, or displace or remove any building, tables, benches, fixtures, fireplaces, grills, railings, playground equipment, paving or paving material, water lines or other utilities, parts or appurtenances whatsoever, either real or personal, or have in his possession any of the foregoing things or objects, or any part thereof.
      2.   No person shall despoil, litter, deface, or create an unsanitary condition in a restroom or washroom. No person over the age of six (6) years shall use the park restrooms and washrooms designated for the opposite sex. Both sex and unisex bathrooms shall be excluded from this provision.
      3.   No person shall damage, cut, carve, transplant, or remove any tree or plant, or injure the bark, or pick the flowers or seeds, of any tree, fruit or plant. Nor shall any person attach any rope, wire or other contrivance to any tree or plant. No person shall dig in or otherwise disturb grass areas or in any other way injure or impair the natural beauty or usefulness of any area, unless they have first received approval from the Public Works Supervisor.
   (J)   Unlawful Urination Or Defecation: No person shall urinate or defecate in any park except in a convenience station designed for that purpose; or blow, spread, or place any nasal or other bodily discharge; or spit, urinate, or defecate on the floors, walls, partitions, furniture, fittings, or any portion of any public convenience station or in any place in such station, excepting directly into the particular fixture provided for that purpose; or place any bottle, can, cloth, rag, or metal, wood, or stone substance in any of the plumbing fixtures in any such station.
   (K)   Metal Detecting/Worm Gathering: It is prohibited for any person to use, place or attempt to place, an electric probe or any similar device, for the purpose of detecting metal or collecting worms in any park.
   (L)   Obscene Language: While in a park, no person shall use obscene, abusive or threatening language; use or threaten any act of violence; engage in riotous or disorderly conduct.
   (M)   Amplification Devices: While in a park, no person shall use a radio, loudspeaker, CD player, tape player, or any other amplification device, which can be heard at a distance of more than fifty feet (50') from the source of the amplified sound.
   (N)   Fire: No person shall start, ignite, maintain or assist in starting, igniting or maintaining a fire, except in a grill or fireplace, which is attended at all times. All fires that are properly maintained shall be extinguished upon leaving the park.
   (O)   Interference With Others: No person shall engage in any conduct, which interferes with another person's reasonable use and peaceful enjoyment of a park.
   (P)   Admission Fees For Events: No group or event shall be allowed to charge fees of any sort for events held within parks without first obtaining a special event permit upon approval of the City Council.
   (Q)   Exiting Park: No person shall refuse to leave a park when directed to do so by a police officer or a member of the Public Works Department when that person has engaged in any activity prohibited by this chapter. Any person ejected from a park shall leave promptly and peaceably and shall not return to the park for any reason on the same calendar day of his ejection.
   (R)   Pathways And Footpaths: No person shall ride or drive any horse or other animals, or propel any vehicle on pathways/footpaths unless authorized by the City. (Ord. 390, 3-4-2019)
