8-8-9: UNLAWFUL AND PROHIBITED ACTS AND CONDUCT:
   (A)   It is unlawful for any unauthorized person to change, alter, destroy, disturb, meddle, tamper or interfere with, any head gate, dam, weir, water box or other measuring or delivery device, placed, used or regulated by the City for the purpose of administering the Municipal irrigation system.
   (B)   It is unlawful for any person:
      1.   To place in any ditch earthen dams or checks;
      2.   To injure, damage or destroy ditches, laterals, pipes, flumes, culverts or other devices within the City by which irrigation water is conveyed or distributed to the inhabitants thereof, or to permit livestock of any kind owned by him or in his charge to trample down, damage, injure or destroy the same.
   (C)   It is unlawful for any person to divert or otherwise appropriate Municipal irrigation water provided through the Municipal irrigation system in any manner not in compliance with the irrigation schedule for that property.
   (D)   It is unlawful for any person to divert or otherwise appropriate or use Municipal irrigation water provided through the Municipal irrigation systems when the assessment or assessments levied against said property have not been paid as required by this chapter.
   (E)   It is unlawful for any unauthorized person to meddle, dam, turn, interfere, or in any manner tamper with the irrigation water and disarrange the schedule of the Municipal irrigation system and thereby deprive any user or landowner entitled to the use of the water, from the uninterrupted use and benefit of his turn of the water.
   (F)   Violation of any of the provisions of this section shall constitute a misdemeanor. (Ord. 393, 5-20-2019)
