(A) On and after October 1, 2020, and pursuant to Idaho Code section 50-1803, any person who owns shares and receives delivery of irrigation water from the City of New Plymouth Municipal Irrigation System, shall assign those shares to the City of New Plymouth, to be held in trust for that person and to insure the delivery of water to which that person and shares may be entitled.
(B) Upon assignment of a share or shares, and pursuant to Idaho Code section 50-1804, the City of New Plymouth shall issue a City water certificate to the assignor of the share or shares, showing that such assignor is entitled to all the water to which he was originally entitled under the share or shares originally issued by the canal or irrigation company providing the water, and which certificates shall be signed by the Mayor and Clerk of the City with the Corporate Seal affixed. The City water certificate shall guarantee that upon assignment, the owner of the share or shares is entitled to the full property rights concerning the use and benefit to be derived from the water originally enjoyed under such assigned share or shares.
