8-8-5: CONNECTIONS:
   (A)   Each property within the boundaries of the Municipal irrigation system may be connected to the irrigation main through a City irrigation service line sufficient to deliver the shares of water, upon compliance with the terms of this chapter.
   (B)   No irrigation water shall be provided by the Municipal irrigation system unless the City is satisfied that all rules and regulations provided for the Municipal irrigation system have been fulfilled, and all fees set forth in the rate schedule adopted by resolution of the City Council have been paid.
   (C)   Service connections shall be made only to irrigation mains, and no connections shall be made to the circulating lines. Where existing service connections have been attached to trunk or circulating lines, the City shall have the right, at its expense, to remove the same and attach them to irrigation mains.
   (D)   Each property owner shall furnish pipe and valves required for the service connection, at his own cost and expense, together with the necessary excavation and replacement for the installation thereof.
   (E)   The City shall make the actual connection between the service line and the City main.
   (F)   Each parcel entitled to a share or shares of water shall require a separate connection for the delivery of water pursuant to those shares.
   (G)   No connection to the Municipal irrigation system shall be made and no irrigation shall be permitted to flow into the connection except upon the inspection of and approval by the City.
   (H)   Head gates, weirs, delivery boxes or other measuring or delivery devices for the delivery or measurement to individual users of irrigation water shall be paid for by the City.
Installation of the irrigation measuring or delivery devices shall be owned by the City and the City shall be responsible to keep the irrigation measuring or delivery devices in good working order.
   (I)   The duty of the City to keep the measuring and delivery devices in repair shall not prevent the City from seeking recovery of the costs of repairs from responsible parties who may intentionally or negligently damage those devices.
   (J)   Should the property owner cause damage to the City system, the property owner shall be responsible to pay the cost of any repairs to the system. Failure to pay for the cost may result in the City refusing to deliver water until such costs are paid.
   (K)   Damage to delivery points caused or allowed to occur by the property owner may be deemed the responsibility of the property owner at the discretion of the Public Works Superintendent or designee, in which case the City may effect repair and invoice the property owner for the cost of delivery point repair.
   (L)   For those delivery points with valves owned by the property owner, the property owner shall be responsible for proper operation of the valve for the access of irrigation water. Any damages resulting from improper valve operation, including but not limited to unintended flooding of property if the valve is left open and/or damage to the delivery point or valve through misuse, shall be the responsibility of the property owner.
   (M)   No person supplied with water from the Municipal irrigation system will be entitled to use it for any purpose other than irrigation of that subject property and/or watering of animals. Irrigation water shall not be supplied to other properties or diverted to other property or uses with the intent of bypassing the provisions of this chapter.
   (N)   Wastewater from the use of the irrigation system shall either be retained on the property entitled to the delivery of water or shall be diverted and returned to the Municipal irrigation system. Any wastewater that moves onto property that does not own a share and is not entitled to use water from the Municipal irrigation system and is used by that property for irrigation purposes shall not be construed to create a water right and any other entitlement to that wastewater at any time.
   (O)   Any property owner with ownership of existing shares that does not have an existing hook up to the Municipal irrigation system and that seeks to join the Municipal irrigation system after the adoption of this chapter, shall pay a service hook-up fee to the City as may be adopted from time-to-time by resolution of the City Council.
