(A) The provisions of this chapter shall apply only to that system assumed by the City of New Plymouth pursuant to the agreement of April 20, 2010 with the New Plymouth Water Users Association and only to the property served by that system within the corporate limits of the City of New Plymouth or as may hereafter be enlarged or contracted by the City Council. The boundaries of the system in any event shall not exceed the existing corporate boundaries of the City of New Plymouth, which are hereby established as the boundary of the Municipal irrigation system.
(B) The City Council may, from time to time, contract, extend or enlarge the boundaries of said system by ordinance. In the case of boundary extension or enlargement of the City limits through annexation, the property owner brought into the City limits through annexation shall not be entitled to automatic inclusion in the Municipal irrigation system. Said property owner shall be required to provide proof that they own sufficient shares from Farmers to deliver water to the property and shall pay any and all costs of extension of the system to that property. In addition, any property owner that seeks to join the Municipal irrigation system after annexation shall pay a service hook-up fee to the City as may be adopted from time-to-time by resolution of the City Council.
