6-12-2: VIOLATION CRITERIA:
   (A)   Electronically Amplified Sound: No person shall cause, suffer, allow, or permit the operation of any source of electronically amplified sound on or in any property, public space, or right of way, in such a manner that the sound pressure level produced by the source exceeds the limits set forth in subsection (B) of this section.
   (B)   Allowable Sound Pressure Levels: Table 1 of this section sets forth the maximum allowable overall sound pressure levels produced by any source of electronically amplified sound, as a function of receiving property category, time of day and type of measurement and weighting.

   (C)   Violations Enumerated: Any of the following acts are a violation of this chapter:
      1.   The maximum sound pressure level equals or exceeds the appropriate Lmax criterion shown in table 1 of this section at any instant.
      2.   The ten percent (10%) exceedance level (sound level exceeded during 10 percent of the measurement period) equals or exceeds the appropriate L10 criterion shown in table 1 of this section, at the conclusion of a continuous measurement period of at least fifteen (15) minutes;
Alternatively, a violation pursuant to this criterion is indicated if the observed sound pressure level equals or exceeds the appropriate L10 criterion shown in table 1 of this section, for a cumulative total of ninety (90) seconds, or one and one-half (1.5) minutes, during any fifteen (15) minute measurement period.
      3.   The equivalent continuous sound pressure level equals or exceeds the appropriate Leq criterion shown in table 1 of this section, at the conclusion of a continuous measurement period of at least fifteen (15) minutes.
      4.   The fifty percent (50%) exceedance level (sound level exceeded during 50 percent of the measurement period) equals or exceeds the appropriate L50 criterion shown in table 1 of this section, at the conclusion of a continuous measurement period of at least fifteen (15) minutes;
Alternatively, a violation pursuant to this criterion is indicated if the observed sound pressure level equals or exceeds the appropriate L50 criterion shown in table 1 of this section, for a cumulative total of seven and one-half (7.5) minutes, during any fifteen (15) minute measurement period.
      5.   Example: A violation would occur in the evening (7:00 P.M. - 10:00 P.M.), in a residential location, if:
Per subsection (C)1 of this section, the maximum sound pressure level (Lmax) is 70 dBA/75dBC or higher at any time, and/or
Per subsection (C)2 of this section, the ten percent (10%) exceedance sound pressure level (00) is 60 dBA/65dBC or higher at the conclusion of a minimum fifteen (15) minute measurement, and/or
Per subsections (C)3 and (C)4 of this section, the equivalent continuous sound pressure level (Leq) and/or the fifty percent (50%) exceedance sound pressure level (L50) is 55 dBA/60dBC or higher at the conclusion of a minimum fifteen (15) minute measurement.
   (D)   Pure Tones:
      1.   A sound source which propagates an intense pure tone to any receiving location, regardless of the overall sound pressure level, is in violation of this chapter;
      2.   The compliance limits set forth in table 1 of this section shall be reduced by five (5) decibels for any source which propagates a pure tone to any receiving location. (Ord. 278, 9-16-2002)
