(A) No dog or other animal that has been declared to be vicious by the animal control board shall remain in, visit or be kept within the city limits of the city of New Plymouth.
(B) In the event that the owner of a vicious animal refuses to surrender the animal to the law enforcement agency designated by the city or to the animal control officer, the city may seek a search warrant or any other appropriate warrant or order from a magistrate judge of the district court and seize the animal upon execution of the warrant.
