6-2-6: DOGS RUNNING AT LARGE PROHIBITED:
   (A)   It shall be unlawful for any owner to allow or permit any dog whether licensed or not to be or remain upon the streets or alleys of the City or in a public place in the City or off the owner's premises and upon the premises of another without the consent of the person in possession of such other premises unless:
      1.   Such dog be in the charge of a person and controlled by a leash not exceeding ten feet (10') in length.
      2.   Such dog be confined in a motor vehicle.
   (B)   The first time a dog shall be found running at large in violation of this section, a complaint shall be lodged with the law enforcement agency in charge of enforcing City ordinances. Upon such a complaint, a written warning shall be issued to the owner of the dog or to the person who is then in control of the dog.
   (C)   A second or subsequent time that a dog is found to be running at large in violation of this section and after a written warning has been provided, any peace officer observing the dog running at large in violation of this section or who receives a complaint about the dog running at large, shall have the authority to issue a citation to the animal's owner or to the person in control of the dog. Whenever a person shall be found guilty of violating this section, he shall be fined as follows:
      First offense shall be an infraction punishable by a fine not to exceed twenty five dollars ($25.00).
      Second offense within twelve (12) months shall be an infraction punishable by a fine not to exceed fifty dollars ($50.00).
      Third or subsequent offense within twelve (12) months shall be an infraction punishable by a fine not to exceed one hundred dollars ($100.00).
It shall be no defense that a person has exchanged dogs since the date of the last offense. (Ord. 383, 7-16-2018)
