§ 51.99 VIOLATIONS; PENALTY.
   (A)   The failure of any person, entity, officer or agent of a corporation in charge or control of a property in violation of this chapter who fails to promptly and properly remove any unwholesome environmental condition shall, in addition to the cost of remediation incurred by the town, be fined the following amounts for the following offenses for each day the property exists in violation of this chapter to constitute a separate offense:
      (1)   First offense:      $500;
      (2)   Second offense:   $1,000;
      (3)   Third offense:      $1,500;
      (4)   Fourth offense:   $2,000;
      (5)   Fifth offense:      $2,500.
   (B)   In addition thereto, should the town be required to retain the services of an attorney to enforce this chapter, they shall be entitled to collect the attorney's fees as an additional penalty under this chapter.
