§ 36.02 FEE AND BOND REQUIRED.
   It shall be unlawful for any person, persons, organization, corporation or business entity to dig within the town upon any area in which the town has an easement without first paying to the Clerk-Treasurer of the town a fee in an amount as set by the Town Council from time to time upon application for a right-of-way cut permit, without first providing a performance bond in a minimum amount as set by the Town Council from time to time with the amount to be increased to equal the estimated costs of repairs to the town's right-of-way easement, without first agreeing to furnish a flagman or flagmen and to erect and maintain all necessary barricades, detour signs and warning lights required to safely direct traffic over or around the location where the work is to be done and without meeting all other requirements designated by the Street Commissioner of the town.
