For regulated drains not located in platted subdivisions, unless otherwise accepted by the Town Council and/or Town Manager and/or Building Commissioner, no permanent structure (including fences) shall be erected within 75 feet measured at right angles from: (1) the existing top edge of each bank of a regulated open drain, as determined by the Town Council and/or Town Manager and/or Building Commissioner; or (2) the center line of a tiled regulated drain.
