351.16 SNOW PARKING BAN; OBSTRUCTING STREETS.
   (a)   Snow Emergency Defined. A snow emergency is defined as that time when there has been in or on any of the streets or roads of the Village any accumulation of snow, sleet, hail or ice. When such an accumulation has occurred the Mayor or the Village Administrator shall, if in his or her opinion the accumulation has created hazardous driving conditions, announce and proclaim that a snow emergency exists and that emergency parking regulations hereinafter defined shall therefore be and remain in effect until such emergency period is by the Mayor or Village Administrator proclaimed and announced to be ended.
   (b)   Whenever such an emergency exists, the Mayor or the Village Administrator or his or her designee shall request the cooperation of the local press and radio and television stations to announce the emergency and the time that the emergency parking ban shall become effective, which time shall be no sooner than one hour after the first announcement to the above named news media. Such announcement to the news media shall constitute notice to the general public of the existence of the emergency. The owners and operators of motor vehicles shall have full responsibility to determine existing weather conditions and to comply with the emergency parking ban.
   (c)   No Parking During Snow Emergency. During the snow emergency, no person shall park, or cause to be parked or permit to be parked or permit to remain parked, or abandon or leave unattended, any vehicle of any kind or description upon the streets. However, vehicles may be parked for a period of no longer than three minutes for actual loading or unloading of passengers or thirty minutes for actual loading or unloading of property, provided that no other ordinance restricting parking as to place or time is violated thereby.
   (d)   Removal of Vehicles Parked During Emergency. The Mayor or any employee at his direction or any member of the Police Department shall be authorized and empowered to provide for the removal of any vehicle parked on any of the streets or roads of the Village during a period of snow emergency as defined in subsection (a) hereof, to such garage or other place the Mayor or other person under his direction or member of the Police Department deems proper. Any cost incurred in such removal or storage shall be paid by the owner of the vehicle, in addition to any fines and/or penalty which may be imposed on the owner or operator of the vehicle.
   (e)   Placing of Ice or Snow in Streets.   The owner, occupant or person having the care of any building or lot of land who during the course of removing snow and ice from his property and deposits same in the streets shall be considered in violation of this section and subject to any fines or penalties which may be imposed. This subsection is effective with any snowfall and/or icy conditions independent of a snow emergency declaration and shall be enforced by the police upon finding or being notified that such violation exists.
   (f)   Piling of Snow or Ice. The owner, occupant or person having the care of any building or lot of land who during the course of removing snow and ice from his property and piles, stocks or positions same in such a manner as to obstruct the vision of motorists on a City street, road or private drive shall be considered in violation of this section and subject to any fine or penalties which may be imposed. This subsection is effective with any snowfall and/or icy condition independent of a snow emergency declaration and shall be enforced by the police upon finding or being notified that such violation exists.
   (g)   Penalty. Whoever is convicted of or pleads guilty to a violation of this section shall be fined not more than fifty dollars ($50.00).
