339.99 PENALTY.

   (a)   Whoever is convicted of or pleads guilty to a violation of exceeding the weight limitations of Section 339.01 or 339.02 shall be imprisoned for a definite term or fined, or both, which term of imprisonment and fine shall be fixed by the court as follows:

 

Amount Overweight	Maximum Term of Imprisonment	Maximum Fine
1 to 2,000 lbs.	No imprisonment	$80.00
2,001 to 5,000 lbs.	No imprisonment	$100.00 plus $1.00 per 100 lbs.
5,001 to 10,000 lbs.	30 days	$130.00 plus $2.00 per 100 lbs.
10,000 lbs. and over	30 days	$160.00 plus $3.00 per 100 lbs.

   (b)   Whoever is convicted or pleads guilty to a violation of any other provision of Sections 339.01 or 339.02 or of any other provision of this chapter shall be subject to the penalty provisions set forth in Section 303.99.
