921.05 RUBBISH AND GARBAGE COLLECTION.
   (a)   The Village Fiscal Officer is authorized, empowered and directed to issue licenses for the collection of garbage and rubbish from commercial establishments throughout the Village. The Village may enter into garbage and rubbish collection after the termination of all outstanding licenses which can take effect only after a thirty day written notice of termination.
   (b)   The Village Administrator is authorized and directed to prepare specifications and with the consent of the Village Council, to authorize the issuance of a franchise to a person, firm, or corporation, after advertising and receiving bids as required by law, for the collection, transportation, and disposal of rubbish material, refuse and garbage from residences on dedicated streets within the Village for a period not to exceed five (5) years, subject to any other provisions of this chapter.
   (c)   The franchise shall entitle the holder to be the only collector of rubbish material, refuse and garbage for hire from all residences within the Village which have curbside collection on a dedicated street.
   (d)   A franchise may be terminated by the Mayor, with the consent of the Village Council if any franchise fails to comply with the provisions of this chapter or any rule or regulation promulgated by the Director of Service.
   (e)   Collection of rubbish material, refuse and garbage from residential property on dedicated streets by any person or firm or corporation not authorized to do so pursuant to this chapter is prohibited. (Ord. 2020-03. Passed 7-13-20.)
