Any defendant in jeopardy of incarceration in any misdemeanor proceeding before the Municipal Court shall be entitled to a trial by jury unless such defendant shall affirmatively waive, in writing, such right; provided, however, the Municipal Court Judge, in their discretion, may signify on the docket in advance of trial that under no condition will a jail sentence be imposed, and the foregoing waiver shall not be required and the defendant shall not be entitled to a trial by jury. In all cases where required by the Constitution or Statutes of the State, the Municipal Judge shall empanel a jury to hear the evidence and decide the case. The Court shall promulgate rules for the selection and empaneling of jurors in such cases. All costs incurred in connection with jury trials shall be awarded against, and be payable by the party against whom judgment is rendered.
