(A) Locations. A mobile food unit/cart may only operate in the locations set forth in this section. A mobile food unit/cart may operate in a private commercial or industrial parking lot and on private residential property, with the written consent of the private property owner. When operations occur on private residential property, mobile food unit/cart sales may only be for catering purposes (such as a private graduation party or wedding) and not open for sales to the general public. A mobile food unit/cart may only operate in a city park or on city property with the prior written approval by the city.
(B) Performance standards. A mobile food unit/cart licensee is subject to the following performance standards:
(1) A mobile food unit/cart with an annual license may not operate on the same property more than 21 days (M.S. § 157.15, subd. 9).
(2) No mobile food unit/cart sales between 11:00 p.m. and 7:00 a.m., without prior approval if not in conjunction with a city festival or event.
(3) A mobile food unit must dispose of its gray water daily. Gray water may not be drained into city storm water drains.
(4) A mobile food unit/cart must provide a waste receptacle for its customers and take the trash away to be disposed of properly. No trash shall be disposed of in any city dumpsters/receptacles.
(5) An out of service mobile food unit/cart may be stored only in an area zoned M-1 and where outside storage is allowed by conditional use permit.
(6) The mobile food unit/cart may have a maximum bumper to bumper length of no more than 30 feet.
(7) No more than two parking spaces may be used by any one mobile food unit/cart for parking and accessories (i.e., tables, chairs, benches, signs, etc.)
(8) A mobile food unit/cart is not required to obtain a sign permit from the city. However, no additional signage is permitted beyond that which is on the mobile food unit unless it meets the following requirements:
(a) One single sandwich board style sign is permitted per mobile food unit/cart;
(b) The maximum sign size is eight square feet;
(c) The sign must be placed on the ground and within ten feet of the mobile food unit/cart;
(d) The sign must not be placed within the public right-of-way except with the express written permission of the city; and
(e) The sign cannot project from the mobile food unit/cart or be mounted to the roof of the mobile food unit/cart.
1. A mobile food unit with a Type 1 cooking hood shall have said hood cleaned at least annually as required by the applicable regulations.
2. A mobile food unit with a fire suppression system under the cooking hood shall have the system tested and tagged in accordance with applicable codes.
3. A mobile food unit/cart must have at least one 2A:20BC fire extinguisher in the mobile food unit/cart. If deep frying occurs in the mobile food unit, then the mobile food unit must have at least one Class K fire extinguisher in the mobile food unit. Each fire extinguisher must display an inspection tag dated within the past 12 months.
4. A licensee must comply with all laws, ordinances, regulations, parking zones, and posted signs.
5. A mobile food unit/cart must provide an independent power supply that is screened from public view.
6. Propane tanks must be attached or secured to the mobile food unit and must be adequately ventilated.
(C) License. A mobile food unit/cart license is non-transferable. Proof of license shall be displayed at all times in/on the mobile food unit/cart.
(D) Practices prohibited. It is unlawful for any person engaged in the business of a mobile food unit/cart operation to do the following:
(1) Call attention to that licensee's business by crying out, blowing a horn, ringing a bell or by any loud or unusual noise, or by use of any amplifying device;
(2) Fail to display proof of license and produce valid identification when requested;
(3) Remain on the property of another when asked to leave;
(4) Claim endorsements by the city based on license; or
(5) Conduct business in any manner as to create a threat to the health, safety, and welfare of the general public.
