The owner of a dog determined to be a vicious dog may be prohibited by the City of New Lexington from owning, possessing, controlling, or having custody of any dog for a period of up to three years when it is found, after proceedings conducted under Section 503.05, that the ownership or possession of a dog by that person would create a significant threat to the public health, safety, and welfare.
(a) No person shall keep or harbor any dog within the Municipality which, by frequent and habitual barking, howling or yelping, creates unreasonably loud and disturbing noises of such a character, intensity and duration as to disturb the peace, quiet and good order of the Municipality. Any person who shall allow any dog habitually to remain, be lodged or fed within any dwelling, building, yard or enclosure, which he occupies or owns, shall be considered as harboring such dog.
(b) Whoever violates this section is guilty of a minor misdemeanor.
Any violation of this chapter involving a dangerous dog shall be punished by a fine not to exceed $100.00 Any violation of this chapter involving a vicious dog shall be punished by a fine not to exceed $200.00.
All fines paid pursuant to this Chapter shall be paid to the City of New Lexington for the purpose of defraying the cost of the implementation of this Chapter.
