1331.04 UNCONTROLLED VEGETATION AS A PUBLIC NUISANCE.

   (a)   This section establishes and defines the basis upon which noxious weeds and rank vegetation shall be classified “public nuisances.”

   No owner or private residential or vacant property as defined in this section shall permit noxious weeds and rank vegetation to grow thereon to a height in excess of twelve inches.

   (b)   Definitions.

      (1)   Noxious weeds and rank vegetation: As defined in Chapter 921.

      (2)   Owner: As defined in Section 1331.03 (b)(6).

      (3)   Private residential property and vacant property: As defined in Section 1331.03 (b)(3) and (4).

      (4)   Total cost: As defined in Section 1331.03 (b)(5).

   (c)   Procedure for Finding of Public Nuisance. As defined in Section 1331.03 (d)(1) and (2).

   (d)   Appeal Procedure. As defined in Section 1331.03 (e)(1) to (3).

   (e)   Abatement of Nuisance. As defined in Section 1331.03 (f)(1) and (2).

   (f)   Remedies Not Exclusive. As defined in Section 1331.03 (g).
