The ICC International Property Maintenance Code 2009, as adopted herein is amended and changed in the following respects:
(a) 102.3 Application of other codes shall be amended by changing the following: Delete International Existing Building Code and insert State of Ohio Building Codes, delete International Zoning Code, and insert adopted Zoning Codes by ordinances of the Village of New Lexington.
(b) Section 103.5 Fees: Any Fees and a Fee Schedule will be adopted by separate Ordinance.
(c) Section 106.4 Violation penalties shall be amended by adding the following: Violations of this Code shall be punished as provided in Section 1313.99
of the Codified Ordinances.
(d) Section 111 shall be deleted.
(e) Section 112.4 insert fine amounts; not less than $250.00 or more than $1000.00.
(f) Section 201.3 Delete references to International Building Code, International Fire Code, International Zoning Code, International Plumbing Code, International Mechanical Code and insert Ohio Building Code, Residential Code of Ohio, Ohio Fire Code, Zoning Code per Codified Ordinances of the Village of New Lexington.
(g) Section 302.1.1 Exterior Property Areas shall be added to read as follows: No person in any Residential District of the Village of New Lexington shall store, collect, park, leave, deposit, maintain, reserve, put aside for future use, permit, allow or suffer to remain in a yard, except in a completely enclosed building or structure, any lumber, equipment or materials used in the construction trade, except those related to construction on the premises for which a current zoning permit has been issued and is posted.
(h) Section 302.1.2 Exterior Property Areas shall be added to read as follows: Only furniture specifically designed for exterior use shall be permitted on porches, patios, decks, or in yards or in yard structures. Exception: Shall not apply to porches or decks completely enclosed for all weather use.
(i) Section 302.1.3 Exterior Property Areas shall be added to read as follows: No bagged, boxed or loose storage shall be permitted on porches or decks with the exception that trash storage containers may be kept on rear or interior side porches.
(j) Section 302.4 Weeds to be inserted 8" as plant growth. Add 302.4.1 Property owners and/or tenants shall mow or cut as described in Section 302.4 to the edge of abutting streets or alleys including to the center line of adjoining center street/tree lawns (islands) and along all fences, walls or buildings.
(k) Section 304.1.1 Unsafe Structures shall be amended to read as follows: the following conditions shall be determined as unsafe and shall be repaired or replaced to comply with the Ohio Building Code or the Residential Code of Ohio as required for existing buildings.
(l) Section 304.14 Insect screens, insert dates of April 1 to December 1.
(m) Section 305.1.1 Unsafe conditions shall be amended to read as follows: The following conditions shall be determined as unsafe and shall be repaired or replaced to comply with the Ohio Building Code or the Residential Code of Ohio as required for existing buildings.
(n) Section 306.1.1 Unsafe conditions shall be amended to read as follows: Where any of the following conditions cause the component or system to be beyond its limit state, the component or system shall be determined as unsafe and shall be repaired or replaced to comply with the current adopted Ohio Building Code or the Residential Code of Ohio as required for existing buildings.
(o) Section 307.1 General shall be amended to read as follows: Every exterior and interior flight of stairs having four or more risers shall have a handrail on one side of the stair and every open portion of a stair, landing, balcony, porch, deck, ramp or other walking surface which is more than 30 inches (762 mm) above the floor or grade below shall have guards. Handrails shall not be less than 34 inches high or more than 38 inches high measured vertically above the nosing of the tread or above the finished floor of the landing or walking surfaces. Guards shall not be less than 36 inches high above the floor or the landing, balcony, porch, deck or ramp or other walking surface.
Exception: Guards shall not be required where exempted by the Ohio Building Code or the Residential Code of Ohio.
(p) Section 401.3 Alternative devices shall be amended by the following change: Delete International Building Code and insert Ohio Building Code or the Residential Code of Ohio.
(q) Section 403.1.1 Habitable Spaces shall be added to read as follows: The interior side of a window shall not be covered with any material other than that which is specifically designed for window cover such as blinds, curtains, drapes or shutters.
(r) Section 502.5 General shall be amended by the following change: Delete International Plumbing Code and insert Ohio Plumbing Code.
(s) Section 505.1 General shall be amended by the following change: Delete International Plumbing Code and insert Ohio Plumbing Code.
(t) Section 602.2 Residential occupancies shall be amended to read as follows: Dwellings shall be provided with heating facilities capable of maintaining a room temperature of 65° F (18° C) in all habitable rooms, bathrooms and toilet rooms. Cooking appliances and portable space heaters shall not be used to provide space heating to meet the requirements of this section.
(u) Section 602.3 Heat supply shall be amended to read as follows: Every owner and operator of any building who rents, leases or lets one or more dwelling unit, rooming unit, dormitory or guest room on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat during the period from October 1 to May 15 to maintain a temperature of not less than 65° F. (18° C) in all habitable rooms, bathrooms and toilet rooms.
(v) Section 602.4 Occupiable work spaces shall be amended to read as follows: Indoor occupiable work spaces shall be supplied with heat during the period from October 1 to May 15 to maintain a temperature of not less than 65° F (18°C) during the period spaces are occupied.
(w) Section 604.2 Service shall be amended by the following change: Delete NFPA 70 and insert National Electric Code and 60 amperes to 100 amperes.
(x) Section 604.3.1.1 Electrical Equipment shall be amended by the following change: Delete International Building Code and insert Ohio Building Code or Residential Code of Ohio.
(y) Section 604.3.2.1 Electrical Equipment shall be amended by the following change: Delete International Building Code and insert Ohio Building Code or Residential Code of Ohio.
(z) Section 702.1 General shall be amended by the following change: Delete International Fire Code and insert Ohio Fire Code.
(aa) Section 702.2 Aisles shall be amended by the following change: Delete International Fire Code and insert Ohio Fire Code.
(bb) Section 702.3 Locked Doors shall be amended by the following change: Delete International Building Code and insert Ohio Building Code or Residential Code of Ohio.
(cc) Section 704.1 General shall be amended by the following change: Delete International Fire Code and insert Ohio Fire Code.
(dd) Section 704.2 Smoke alarms shall be amended by the following change: Delete International Fire Code and insert Ohio Fire Code.
(ee) Appendix A, Sections A102.1, A102.2 and A102: Delete International Building code and insert Ohio Building Code or Residential Code of Ohio.
