8-8-7: USE REGULATIONS:
   A.   Fishing License Required: As required by the state of Oklahoma department of wildlife conservation, fishing licenses are required for fishing on the Cordell wildlife management and public use area.
   B.   Fees: The city council shall provide by rules, from time to time, the fees charged for any such entrance and recreational use privileges on the Cordell reservoir wildlife management and public use area. (1997 Code § 11-214D)
   C.   Firearms, Wildlife Harvesting Devices And Hunting: The possession or use of firearms, crossbows, longbows, traps, seines, yo-yos, nets or any other similar device commonly used to harvest fish and wildlife resources is prohibited. The use of these devices to take, attempt to take, harvest, attempt to harvest, harass, attempt to harass, destroy, or attempt to destroy any natural resource or public use facility of the Cordell wildlife management and public use area is prohibited. (1997 Code § 11-214E)
   D.   Domestic And Exotic Animals:
      1.   All domestic and exotic animals including dogs, cats, horses, donkeys, mules and any other exotic and domestic animals are prohibited on the Cordell fish and wildlife management and public use area. Only those domestic animals registered for support of physically impaired people shall be allowed on the area.
      2.   The running at large, herding, driving across, allowing on, pasturing or grazing of livestock of any kind in the area is prohibited.
      3.   Estray livestock trespassing in the area may be impounded by the city. After impoundment, attempt shall be made to contact the rightful owner. If contact cannot be made, the city shall proceed with sale of the unclaimed livestock. The city shall be paid actual costs of impound, maintenance and damages which have accrued during the impoundment period from the proceeds of the sale of estray livestock. (1997 Code § 11-214F)
   E.   Fires, Fireworks And Smoking:
      1.   Fires: Fires are prohibited except in areas designated by the city administrator. The harvest or attempt to harvest of any living or dead tree, shrub, plant, tree branch, limb or root within the Cordell reservoir fish and wildlife conservation and management and public use area is prohibited.
      2.   Fireworks: The possession or use of any kind of fireworks is prohibited on the Cordell fish and wildlife management and public use area.
      3.   Smoking: The city administrator may designate a portion of the area, or all or a portion of a building, structure or facility, as closed to smoking when necessary to protect natural or cultural resources, reduce the risk of fire, or prevent conflicts among visitor use activities. Smoking in a designated nonsmoking area or location is prohibited. Areas which shall be posted as "no smoking" areas shall include, but not be limited to, area offices and buildings, information centers, restrooms, nature centers, trailways, and areas designated as wildlife preserves. (1997 Code § 11-214G)
   F.   Prohibited Conduct:
      1.   No person shall possess, consume, or sell, or attempt to sell, consume, or possess alcoholic beverages and/or controlled chemical substances.
      2.   No person shall deface or injure, break, cut, mutilate, carry or remove any plant, tree, shrub, flower, stone, stone walk, trail, retention structure, bench, chair, seat, stand, structure, water control structure, boat ramp, pier, fence, property or anything whatsoever in, upon or near the Cordell fish and wildlife management and public use area.
      3.   No person shall chase, kill, set snares for, pet, or tease any animal belonging to the area or kept therein.
      4.   No person shall paste, affix or inscribe any handbill, poster, card, device or inscription to, upon, or against any fence, structure or property of the area.
      5.   No person shall set up any booth, table, stand or other device for vending or retailing any items or services without first obtaining a license therefor from the city.
      6.   No person shall go or walk on any space in the Cordell fish and wildlife management and public use area reserved for flowers or wildlife conservation or otherwise invade any plot reserved by the city for trees, shrubbery, grass, flowers, or any other purposes.
      7.   No person shall disturb or interfere with any legal activity including camping, picnicking, fishing, hiking, walking, social gathering, or program of any individual or group in the park.
      8.   No person shall throw stones or rubbish of any kind into any lake, pond, stream or other place in the Cordell fish and wildlife management and public use area. All trash shall be deposited in receptacles designed for that purpose.
      9.   For the purpose of this subsection F, a person commits disorderly conduct when, with intent to cause public alarm, nuisance, jeopardy or violence, or knowingly or recklessly, creating a risk thereof, such person commits any of the following prohibited acts:
         a.   Engages in fighting or threatening, or in violent behavior.
         b.   Uses language, an utterance, or gesture, or engages in a display or act that is obscene, physically threatening or menacing, or done in a manner that is likely to inflict injury or incite an immediate breach of the peace.
         c.   Makes noise that is unreasonable, considering the nature and purpose of the visitor's conduct, location, time of day or night, and other factors what would govern the conduct of a reasonably prudent person under the circumstance.
         d.   Creates or maintains a hazardous or physically offensive condition. (1997 Code § 11-214H)
   G.   Use Of Exotic Plants And Animals:
      1.   The possession, use for bait, release, or attempt to release any of the following exotic fish or their eggs is prohibited in the Cordell reservoir fish and wildlife management and public use area: walking catfish, grass carp, bony-tongues, piranha group, electric eels, electric catfish, garpike topminnow, shakehead groups, pavon or peacock bass, parasitic South American catfish group, freshwater stingray group, houri, rudd and rudd hybrids, bighead carp, silver carp, black carp, alewives, rainbow smelt, and tilapia.
      2.   The possession, use for bait, release, or attempt to release any other exotic wildlife into the Cordell reservoir fish and wildlife management and public use area is prohibited. (1997 Code § 11-214I)
   H.   Trespassing, Tampering And Vandalism: The following are prohibited. All rules contained in this subsection apply, regardless of public or private ownership, on all lands and waters within the Cordell fish and wildlife conservation and public use area.
      1.   Trespass on any of the city water storage, treatment, handling, transportation, or control structures, or any other area so designated as closed to the public or as a no trespassing area.
      2.   Trespassing, entering or remaining in or upon property or real property not open to the public, except with the express invitation or consent of the person having lawful control of the property or real property.
      3.   Tampering or attempting to tamper with property or real property, or moving, manipulating, or setting in motion any of the parts thereof, except when such property is under one's lawful control or possession.
      4.   Vandalism or destroying, injuring or defacing or damaging property or real property. (1997 Code § 11-214J)
   I.   Certain Motor Vehicles And Aircraft Prohibited:
      1.   It is unlawful for any person to enter with or drive any off road motorcycle, or personal watercraft, including unlicensed three (3) wheel off road vehicles, unlicensed four (4) wheel off road vehicles, tractors, farm implements, motorcycles, personal water vehicles, or similar devices in or upon any road, land, water, or wetlands in the Cordell reservoir fish and wildlife management and public use area. The only exception to this requirement is that prohibited vehicles may be used by city employees and contractors in carrying out necessary maintenance, development and repair activities.
      2.   The following aircraft are prohibited: (1997 Code § 11-214K)
         a.   Powered or nonpowered aircraft.
         b.   Helicopters except in emergencies involving public safety or serious property loss or pursuant to the terms of a permit issued by the city administrator. (1997 Code § 11-214K; amd. 2014 Code)
   J.   Traffic Regulations: It is unlawful for any person to drive any motor vehicle in or upon the Cordell fish and wildlife management and public use area except upon clearly defined public roadways or public parking areas, or except in cases of public necessity when authorized and directed to do so by officials of the city. The speed of any motor vehicle shall not exceed ten (10) miles per hour. (1997 Code § 11-214L)
   K.   Visiting Hours, Closure And Curfew:
      1.   Visiting Hours: Visiting hours within the area are twenty four (24) hours per day throughout the year.
      2.   Closure And Curfew: All or part of the area may be permanently or temporarily closed by the city administrator, consistent with applicable city rules and regulations, for public health and safety, protection of the environment, protection of natural and cultural resources, equitable allocation and use of facilities, alleviating conflicts among visitor use facilities, performance of city operation and management responsibilities, and specific educational or scientific purposes. In addition to the aforementioned, the city may:
         a.   Close all or a portion of the area to all public use or to a specific use or activity.
         b.   Designate areas for specific uses or activities or impose conditions or restrictions on a use or activity.
         c.   Terminate or relax a restriction or limit closure, designation, condition or visitation hour restrictions. (1997 Code § 11-214M)
   L.   Sanitation: The following are prohibited in the Cordell reservoir fish and wildlife conservation and public use area:
      1.   Disposing of refuse in any manner or in any area except refuse receptacles.
      2.   Using the area's refuse receptacles for dumping household, commercial or industrial refuse.
      3.   Disposing of refuse in plumbing fixtures or vaults of a toilet facility.
      4.   Draining sewage and/or gray water from a trailer or recreational vehicle, except in facilities provided for that purpose.
      5.   Washing food, clothing, dishes, or other property at public water outlets, fixtures, pools, or natural lakes, reservoirs or streams, except in areas designated for such purpose.
      6.   Disposing of fish remains on land, in waters, or in a toilet facility.
      7.   Disposing human wastes in other than toilet facilities. (1997 Code § 11-214N)
   M.   Boating Restrictions:
      1.   The use of boats and fishing vessels shall be limited to the large reservoir of the city fish and wildlife management and public use area. Only those fishing vessels having a midline beam length of eighteen feet (18') or less may be launched into the reservoir. Legal boats and fishing vessels include kayaks, canoes, bass buggies, standard fishing boats, and individual tube fishing floats. All fishing vessels, except individual tube fishing floats, must be launched at designated boat launch areas. Only electric motors, oars, sails, or paddles are allowed for propulsion of fishing vessels. No boat shall produce a wake while being operated on the reservoir.
      2.   All fishing vessel trailers and towing vehicles shall be parked in designated areas. The city administrator may post regulations restricting the use of and/or the number of fishing vessels that may use the reservoir at one time.
      3.   Boats and fishing vessels shall not enter areas that are designated as aquatic habitat refuge zones.
      4.   The operation of boats and fishing vessels shall not interfere with the legal fishing activities of other boaters or of bank or pier fishers. (1997 Code § 11-214O)
   N.   Swimming, Diving, Snorkeling, Etc.: It is unlawful to wade, swim, dive, or use snorkel or scuba underwater swimming gear in any of the reservoirs, creeks, wetlands or water treatment facilities of the Cordell fish and wildlife management and public use area. (1997 Code § 11-214P)
   O.   Watchable Wildlife, Hiking And Trailway Regulations: The Cordell watchable wildlife trail system is located to the north of the reservoir road perimeter that surrounds the main reservoir and the downstream areas. This area is specifically designated only for hiking, walking, and the viewing of wildlife resources. Smoking and the use of fires or combustibles is prohibited in the watchable wildlife area and trail system. All fires, including cigarettes, are not allowed. The following regulations apply to this area and its watchable wildlife trail system:
      1.   It is unlawful to disturb the area or any of its facilities including signs, benches, and public information centers.
      2.   All users must stay on the watchable wildlife trailway. All other sections of this area, except designated camping and parking zones, are closed to public use.
      3.   Excessive noise is prohibited.
      4.   It is unlawful to disturb wildlife or their habitat.
      5.   It is unlawful to disturb or interfere with the legal pursuit of wildlife viewing by other wildlife viewers or to disturb their property.
      6.   Do not litter. All litter must either be placed in trash barrels or carried out. (1997 Code § 11-214Q)
      7.   Domestic animals are prohibited, except as certified for use by persons with disabilities. (1997 Code § 11-214Q; amd. 2014 Code)
      8.   Motorized vehicles and bicycles are prohibited.
      9.   It is unlawful to collect or attempt to take wildlife, including invertebrates, amphibians, reptiles, birds, fish, mammals, and plants (including limbs, roots, leaves, fruits, berries, flowers, seeds, or propagules), except on written permission by the city administrator and, as appropriate, the Oklahoma department of wildlife conservation and/or the U.S. fish and wildlife service. (1997 Code § 11-214Q)
   P.   Personal Property:
      1.   Prohibitions: The following are prohibited in the Cordell reservoir fish and wildlife management and public use area:
         a.   Leaving property unattended for longer than forty eight (48) hours, except when authorized by permit from the city administrator.
         b.   Failure to turn in found property to the city administrator as soon as practicable.
      2.   Impoundment Of Property:
         a.   Property, if left unattended in excess of forty eight (48) hours, may be impounded by the city.
         b.   Unattended property that interferes with visitor safety or orderly management of the park area or presents a threat to natural resources may be impounded by the city.
         c.   Found or impounded property shall be inventoried to determine ownership and safeguard such property. (1997 Code § 11-214R)
         d.   Fees shall be charged for the impoundment, removal, storage or other disposition of property pursuant to this subsection P. The owner of record is responsible and liable for all said charges. (1997 Code § 11-214R; amd. 2014 Code)
         e.   Impoundment of motor vehicles and boats shall be conducted in accordance with state law.
      3.   Disposal Of Property:
         a.   Unattended property impounded pursuant to this subsection P shall be deemed to be abandoned unless claimed by the owner or an authorized representative thereof within sixty (60) days. The sixty (60) day period shall begin when the rightful owner of the property has been notified, if the owner can be identified, or from the time the property was placed in the city's custody, if the owner cannot be identified.
         b.   Unclaimed found property shall be stored a minimum of sixty (60) days and, unless claimed by the owner or an authorized representative thereof, may be claimed by the finder.
         c.   All unclaimed abandoned property shall become the property of the city and shall be disposed of in the following manner:
            (1)   Property which can be utilized by the city for official business and which has a value of one hundred dollars ($100.00) or more shall be inventoried as city property and used by the city where such property may be useful.
            (2)   Property which cannot be utilized for official city business and which has a value of one hundred dollars ($100.00) or more shall be inventoried as city property and liquidated under city regulations for disposal of surplus property. (1997 Code § 11-214R)
   Q.   Gambling And Soliciting:
      1.   Gambling in any form, or the operation of gambling devices, for money or anything of value is prohibited.
      2.   Soliciting is prohibited except as approved by the city administrator. (1997 Code § 11-214S)
   R.   Special Events:
      1.   Sports events, pageants, shows, spectator attractions, amateur recreational fishing tournaments, scientific field days, fish and wildlife training seminars and field days, and similar events are allowed; provided, that there is meaningful association between the area and the events, and the observance contributes to the understanding of the significance of the area. A permit therefor must be issued by city administrator before such special events may be conducted. A request for a special event permit shall be denied if the proposed activities would:
         a.   Cause injury or damage to facilities or overuse/overharvest of natural resources.
         b.   Result in the sale of goods or services.
         c.   Unreasonably impair the atmosphere of peace and tranquility of the environment of the area or its natural resources.
         d.   Unreasonably interfere with normal visitor services or program activities.
         e.   Substantially impair the operation of public use facilities or services.
         f.   Present a clear and present danger to public health and safety.
         g.   Result in significant conflict with other existing uses.
      2.   Persons wishing to make application for a special event permit shall complete a written request which shall set forth the name of the applicant, the date, time duration, nature, and place of the proposed event, an estimate of the number of persons expected to attend, and any other information required by the city administrator. The application shall be submitted no later than twenty one (21) days prior to the commencement of the proposed event.
      3.   As a condition of permit issuance, the city administrator:
         a.   May require liability insurance of the applicant.
         b.   Shall require the purchase of a special use group permit and other use permits as required by the current permitting regulations.
         c.   May require a cash payment in an amount equitable to cover the cost of restoration, damage, cleanup, or other costs resulting from the event.
      4.   No such permits shall be issued for a period in excess of four (4) days.
      5.   Violation of the terms and conditions of a permit issued in accordance with this subsection R is prohibited and may result in fines and the suspension or revocation of the permit. (1997 Code § 11-214T)
   S.   Public Assemblies And Meetings; Distribution Of Printed Materials:
      1.   Public assemblies, meetings, gatherings, rallies, demonstrations, the distribution of printed materials and other expressions of views are allowed within the area, provided a permit for such events has been previously issued by the city administrator.
      2.   Persons wishing to make application for such activity shall complete a written application which shall set forth the name of the applicant, the date, time, duration, nature and place of the proposed activity, and estimate of the number of persons expected to attend, and any other relevant information required by the city administrator. The application shall be submitted no later than twenty one (21) days before the proposed commencement of the proposed activity.
      3.   A request for a special public assembly permit shall be denied if the proposed activities would:
         a.   Cause injury or damage to facilities or overuse/overharvest of natural resources.
         b.   Result in the sale of goods or services.
         c.   Unreasonably impair the atmosphere of peace and tranquility of the area's environment or its natural resources.
         d.   Unreasonably interfere with normal visitor services or program activities.
         e.   Substantially impair the operation of public use facilities or services.
         f.   Present a clear and present danger to public health and safety.
         g.   Result in significant conflict with other existing uses.
      4.   Persons wishing to make application for a special public assembly permit shall complete a written request which shall set forth the name of the applicant, the date, time duration, nature, and place of the proposed event, an estimate of the number of persons expected to attend, and any other information required by the city administrator. The application shall be submitted no later than twenty one (21) days prior to the commencement of the proposed event.
      5.   As a condition of permit issuance, the city administrator:
         a.   May require liability insurance of the applicant.
         b.   Shall require the purchase of a special use group permit and other use permits as required by the current permitting regulations.
         c.   May require a cash payment in an amount equitable to cover the cost of restoration, damage, cleanup, or other costs resulting from the event.
      6.   No such permits shall be issued for a period more than four (4) days.
      7.   Violation of the terms and conditions of a permit issued in accordance with this subsection S is prohibited and may result in fines and the suspension or revocation of the permit. (1997 Code § 11-214U)
   T.   Camping And Day Use:
      1.   Definitions: For the purposes of this subsection T, the following definitions for camping and associated functions shall apply:
   MODERN CAMPSITE: A site that may have such features as a table, grill, electrical utility service, and access to restroom and water.
   PRIMITIVE CAMPSITE: A site or area where there are no utilities, sanitation facilities or developments and is generally a significant distance from services.
      2.   General Requirements: The city may establish permits and fees associated with camping, recreational vehicle parking, and travel trailer parking in the Cordell reservoir fish and wildlife conservation and public use area. The city administrator may require permits, designate sites or areas, and establish conditions for camping. Camping is allowed for a maximum of seven (7) consecutive days. Reestablishing a camp will not be allowed for another seven (7) days after the end of a seven (7) day camping period.
      3.   Prohibitions: The following are prohibited:
         a.   Digging or leveling the ground at a campsite.
         b.   Hanging a propane or gas operated lantern on any tree or plant.
         c.   Leaving refuse or human waste after departing a campsite.
         d.   Camping within twenty five feet (25') of a water hydrant or within ten feet (10') of a body of water, except as designated.
         e.   Creating or sustaining unreasonable noise between the hours of ten o'clock (10:00) P.M. and six o'clock (6:00) A.M. However, at any time of the day or night, unreasonable noise will be considered by the nature and purpose of the actor's conduct, impact on park users, location, disturbance of wildlife, interference with the privacy and solitude of other users, and any other factor(s) which would govern the conduct of a reasonably prudent person under the circumstances as determined by an authorized area official.
         f.   The construction of permanent camping facilities or dwellings.
         g.   Failing to obtain required permits.
         h.   Connecting more than one water, electrical or sanitary connection per campsite or connecting to a utility which exceeds its manufactured design or capacity.
         i.   Camping in unauthorized sites or areas as defined by the city administrator.
         j.   Parking a vehicle by occupying or otherwise blocking by any manner any campsite, roadway, or another camping site or using the utility services in a campsite without having first paid campsite or utility fees.
         k.   The placing or parking of two (2) or more recreational vehicles on any site not designed for more than one recreational vehicle.
         l.   Camping longer than the time limits.
      4.   Penalty: Violation of the terms and conditions of this subsection T or the terms and conditions of a permit is prohibited and may result in fines and the suspension or revocation of the camping privilege. (1997 Code § 11-214V)
