7-10-2: SPECIAL PROVISIONS:
   A.   Notwithstanding the definitions of the terms "motor vehicle" and "motorcycle", contained in the Motor Vehicle License and Registration Act, 47 Oklahoma Statutes, 1975, section 562, motor driven cycles, known and commonly referred to as "minibikes", "trail bikes", all-terrain vehicles (ATVs) and other similar trade names, shall not be permitted to be operated on the streets or highways of the City of New Cordell.
   B.   Go-karts, power lawn mowers and other motor vehicles which are manufactured principally for use off the streets and highways shall not be permitted to be operated on the streets or highways of the City of New Cordell. However, this shall not prohibit limited occasional necessary movement of such go-karts, power lawn mowers and other such vehicles on City streets, and shall not prohibit the use of minibikes and trail bikes used by participants in parades.
   C.   Nothing in this section shall be interpreted as prohibiting farm vehicles from using the streets or highways.
   D.   Golf carts, UTVs, LSEVs and small vehicles commonly known as minitrucks are prohibited from operating on Federal and State highways and City streets within the limits of the City of New Cordell, except as follows:
      1.   When the UTV, LSEV, golf cart or minitruck is operated on a City street by a person sixteen (16) years of age or older and possesses a valid operator license during the daylight hours only. Daylight hours are determined to be one-half (1/2) hour after sunrise and one-half (1/2) hour before sunset as listed by the National Oceanic and Atmospheric Administration.
      2.   UTVs, LSEVs, golf carts and minitrucks may operate on a Federal or State highway only if making a perpendicular (90 degree) crossing of a Federal or State highway located within the limits of the City of New Cordell.
      3.   Every person operating a UTV, LSEV, minitruck or golf cart upon a street shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of this State declaring rules of the road applicable to vehicles or by the traffic ordinances of this City applicable to the driver of a vehicle, except as to special regulations in this section and except as to those provisions of laws and ordinances which by their nature can have no application.
      4.   All golf carts, go-karts, power lawn mowers, minitrucks, LSEVs, ATVs and UTVs while operating within the limits of the City of New Cordell shall have a slow moving vehicle emblem which shall be affixed to the rear portion of the aforementioned vehicle. Golf carts and UTVs shall be equipped with a lap safety belt for each occupant of the golf cart or UTV. Passengers under the age of six (6) years old are restricted from riding upon such golf cart or UTV, unless the driver of the golf cart or UTV is twenty one (21) years of age or older. LSEVs shall be exempt from the lap safety belt requirement due to the lower speeds of such vehicles.
      5.   All vehicles subject to this chapter while operating in the limits of the City of New Cordell shall be restricted from operating on a street or highway with a posted speed limit greater than thirty five (35) miles per hour and shall not be driven at a speed greater than twenty five (25) miles per hour.
      6.   No vehicle subject to this chapter may be operated on City streets during periods of rain, snow, or other inclement weather.
   E.   City owned maintenance utility vehicle(s) may be operated anywhere within the City limits of the City of New Cordell while performing authorized City functions. Operation of the maintenance utility vehicle on any street or highway with speed limits posted greater than thirty five (35) miles per hour must be authorized by the City Administrator or his/her designee:
      1.   Permitted only while performing specific tasks.
      2.   Required to be done during normal business hours (daytime only).
      3.   The restriction of use will be determined by the City Administrator or his/her designee.
   F.   All golf cart, LSEV or UTV vehicles operated on any City street of the City of New Cordell will be required to:
      1.   Register the golf cart, minitruck, LSEV or UTV with the Police Department.
      2.   Purchase a City permit for such operation at a rate established by resolution of the City Council. All permits shall expire on December 31st of the year in which they are purchased, and the cost of initial purchase shall be prorated for any period of less than twelve (12) months for which that permit will apply. Subsequent permit purchases for the same golf cart, LSEV or UTV shall be one hundred percent (100%) of the established rate, regardless of when purchased.
      3.   Golf carts, UTVs, LSEVs and minitrucks operating on City streets and highways must carry liability insurance issued through a licensed insurance company unless they are uninsurable because they cannot be classified as an insurable vehicle.
   G.   Violation of this section shall be punished in accordance with section 1-4-1 of this Code and may include fines, the revocation, suspension, cancellation or denial of registration under the provisions of this chapter and code provision, upon conviction by the Municipal Court.
