521.11 NOXIOUS WEEDS AND OVERGROWN GRASSES.
   (a)   Any owner of property having been duly notified by the Village as required by the Ohio Revised Code shall be required to cut or remove all noxious weeds and all lawns over ten (10) inches high within twenty-five (25) lineal feet of any occupied or developed property and/or any dedicated street within the Village.
   (b)   Whenever a property owner fails to comply with subsection (a) hereof within seven (7) days of receipt of written notice as required by the Ohio Revised Code, the Village shall have the property mowed or sprayed as necessary to comply with the requirements herein and charge the cost to the property owner. The minimum charge shall be one hundred dollars ($100.00) for up to two man hours and twenty-five dollars ($25.00) per hour per man thereafter.
   (c)   Failure of any property owner to pay charges as required in subsection (b) hereof, within thirty (30) days shall cause the proper Village official to certify said charges to the Muskingum County Auditor to be assessed to the property taxes of said parcel or property.

521.12 INAPPROPRIATE FURNITURE IN OUTDOOR AREAS.
   (a)   Upholstered or other furniture designed or manufactured primarily for indoor use shall not be used or left:
      (1)   On residential unenclosed, exterior porches or balconies.
      (2)   In an exposed open area of private property.
   (b)   Exceptions:
      (1)   Wood, metal or plastic furniture.
      (2)   Outdoor patio furniture with weather resistant cushions.
      (3)   Upholstered furniture designated for pick-up by public or private haulers complying with Ordinances C-11-03-1, C-9-03-1 and C-7-92-1.
   (c)   If this section or any portion thereof is held to be invalid by any court of competent jurisdiction, said decision shall not affect the validity of the remaining provisions.
   (d)   Whoever violates this section is guilty of a minor misdemeanor on the first offense, and each subsequent offenses shall render such person guilty of a misdemeanor of the fourth degree.

521.13 WATER USE RESTRICTION.
   (a)   The Village Administrator, as well as the Mayor is empowered to declare a water emergency.
   (b)   “Water Use Restriction”, is defined as restriction of water usage from Village supply lines.
   (c)   Such restrictions shall exist from the time a water emergency is formally announced until it is formally canceled.
   (d)   Whenever a water use restriction is declared, the Mayor/Administrator shall request the local news media announce the existence of the restriction, its time of operation, the area in which it will apply and measures required to comply with said restriction. Cancellation shall be accomplished in the same manner.
   (e)   Levels of restriction shall be as follows:
      (1)   Level 1 - All forms of non-essential water use including, but not limited to, lawn sprinkling, watering of gardens, washing of vehicles. This level shall be utilized when it is determined that there is a 90 day water supply.
      (2)   Level 2 - Limits shall be placed upon commercial usage. This level shall be utilized when it is determined that there is a 60 day water supply.
      (3)   Level 3 - Rationing of water. This level shall be utilized when it is determined that there is a 30 day water supply.
   (f)   Whoever violates this section shall be given one (1) written warning notice within ten days of violation. Upon receipt of such notice immediate compliance shall occur. Violation shall be a minor misdemeanor, with each day of violation as a separate offense.

521.14 DISTRIBUTION OF COMMERCIAL AND NON-COMMERCIAL PUBLICATIONS.
   (a)   No person, firm or corporation shall distribute any publications on any unoccupied property and/or any property where the occupant has made a request to cease said distribution.
   (b)   Any person, firm or corporation found guilty of violating any portion of this ordinance shall be guilty of a minor misdemeanor, punishable as permitted by the Ohio Revised Code. (Ord. C-7-95-1. Passed 7-10-95.)
