(a) Upholstered or other furniture designed or manufactured primarily for indoor use shall not be used or left:
(1) On residential unenclosed, exterior porches or balconies.
(2) In an exposed open area of private property.
(b) Exceptions:
(1) Wood, metal or plastic furniture.
(2) Outdoor patio furniture with weather resistant cushions.
(3) Upholstered furniture designated for pick-up by public or private haulers complying with Ordinances C-11-03-1, C-9-03-1 and C-7-92-1.
(c) If this section or any portion thereof is held to be invalid by any court of competent jurisdiction, said decision shall not affect the validity of the remaining provisions.
(d) Whoever violates this section is guilty of a minor misdemeanor on the first offense, and each subsequent offenses shall render such person guilty of a misdemeanor of the fourth degree.
