311.04 USE OF SKATEBOARDS, BICYCLES, SCOOTERS AND IN-LINE SKATES.
   (a)   Except for the SkateSpot, no person shall ride, use, or operate a skateboard, in-line skates, roller skate, or scooter on any public or private; parking lot, property or park where prohibited by the owner, property manager or occupants.
      
   (b)   No person shall ride, use or operate a skateboard, in-line skates, rollers skates, or a bicycle in a discourteous or unsafe manner so as to place other persons or property at risk of harm or create an annoyance, disturbance or nuisance in the operation of such skateboards, in-line skates, roller blades, bicycles, or otherwise impede the normal flow of pedestrian and vehicle traffic on any public or private sidewalk, street, alley, roadway or parking areas.
   (c)   Any apparatus intended to assist disabled persons is exempt from this Ordinance.
   (d)   (1)   Whoever violates subsections (a), (b), or (c) hereof is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) together with the court costs incurred in enforcing this section.
      (2)   In addition to the foregoing penalty, the Village Police Department shall be authorized to confiscate any skateboard, bicycle, in-line skates, roller skates, scooter or similar type of means of transportation used in violation of this section according to the following schedule:
         A.   1st Violation: For a period of time not to exceed thirty (30) days.
         B.   2nd Violation: For a period of time not to exceed sixty (60) days.
         C.   3rd and Subsequent Violation: For a period of time not to exceed one year.
