929.01 DEFINITIONS.
   Unless the context specifically indicates otherwise, the meanings of the following terms as used in this chapter or as used in the rules and regulations adopted by Council to implement the provisions of this ordinance shall be as follows:
   (a)   “Biochemical Oxygen Demand” (or BOD) of sewage, sewage effluent, polluted waters or industrial wastes shall mean the quantity of dissolved oxygen in milligrams per liter required during stabilization of the decomposable organic matter by aerobic biochemical action under standard laboratory determinations shall be made in accordance with procedures set forth in “Standard Method”.
   (b)   “Building (or House) Drain” shall mean that part of the lowest horizontal piping of a building drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to a point approximately three feet outside the foundation wall of the building.
   (c)   “Building (or House) Sewer” shall means the pipe which is connected to the building (or house) drain at a point approximately three feet outside the foundation wall of the building and which conveys the building’s discharge from the point to the public sewer or other place of disposal.
   (d)   “Chemical Oxygen Demand” or (COD) of sewage, sewage effluent, polluted waters or industrial wastes is a measure of the oxygen equivalent of that portion of the organic matter in a sample that is susceptible to oxidation by a strong chemical oxidant. The laboratory determination shall be made in accordance with procedures set forth in “Standard Methods”.
   (e)   “Village” shall mean the Village of New Concord, or any duly authorized officials acting in its behalf.
   (f)   “Effluent” shall mean the water, together with any wastes that may be present, flowing out of a drain, sewer, receptacle or outlet.
   (g)   “Garbage” shall means any solid wastes from the preparation, cooking or dispensing of food and from the handling, storage or sale of produce.
   (h)   “Ground garbage” shall mean garbage that is shredded to such a degree that all particles will be carried freely in suspension under the conditions normally prevailing in public sewers, with no particle being greater than one-half inch in dimension.
   (i)   “Industrial wastes” shall mean any solid, liquid or gaseous substance or form of energy discharged, permitted to flow or escaping from an industrial, manufacturing, commercial or business process or from the development, recovery or processing of any natural resource carried on by any person as defined in subsection (e), and shall further mean any waste from an industrial user as defined in subsection (y).
   (j)   “Influent” shall mean the water, together with any wastes that may be present, flowing into a drain, sewer, receptacle or outlet.
   (k)   “Outlet” shall mean any outlet, natural or constructed, which is the point of final discharge of sewage or of treatment plant effluent into any water course, pond, ditch, lake or other body of surface or ground water.
   (l)   “Person” shall mean any and all persons, natural or artificial, including any individual, firm, company, municipal or private corporation, association, society, institution, enterprise, governmental agency or other entity.
   (m)   “pH” shall mean the logarithm (to the base 10) of the reciprocal of the hydrogen ion concentration of a solution expressed in gram-atoms per liter of solution.
   (n)   “Receiving Stream” shall mean the watercourse, stream or body of water receiving the waters finally discharged from the sewage treatment plant.
   (o)   “Residential Property Unit” shall mean a building under one roof designed, arranged and used primarily for dwelling purposes by a single family.
   (p)   “Sanitary Sewage” shall mean sewage discharged from the sanitary conveniences of dwellings (including apartment houses and hotels), office buildings, factories or institutions and free from storm water, surface water and industrial wastes.
   (q)   “Sewage” shall mean the water-carried wastes from residences, business buildings, institutions and industrial establishments, singular or in any combination, together with such ground, surface and storm waters as may be present.
   (r)   “Wastewater Treatment Plant” shall mean the arrangement of devices, structures and equipment used for treatment and disposing of sewage and sludge.
   (s)   “Sewage works” shall mean all facilities for collecting, transporting, pumping, treatment and disposing of sewage and sludge, namely and sewerage system and wastewater treatment plant.
   (t)   “Sewer” shall mean a pipe or conduit for carrying sewage or other waste liquids.
      (1)   “Combined sewer” shall mean a sewer which carries both storm, surface and ground-water runoff and sewage.
      (2)   “Public sewer” shall mean a sewer in which all owners of abutting property have equal rights and which is controlled by public authority.
      (3)   “Sanitary sewer” shall mean a sewer which carries sewage and to which storm, surface and ground waters and unpolluted industrial waste waters are not intentionally admitted.
      (4)   “Storm sewer” shall mean a sewer which carriers storm, surface and ground water drainage but excludes sewage.
   (u)   “Sewer Engineer” or “Water Pollution Control Engineer” shall mean the duly authorized representative of the Village. The individual designated may be the Village Engineer, Superintendent of the Wastewater Treatment Plant, consulting civil or environmental engineer to the Village, or some similar, knowledgeable and technically qualified person.
   (v)   “Sewerage System” shall mean the network of sewers and appurtenances used for collecting, transporting and pumping sewage to the wastewater treatment plant.
   (w)   “Standard methods” shall mean the examination and analytical procedures set forth in the most recent edition of “Standard Methods for the Examination of Water and Wastewater”, published jointly by the American Public Health Association, the American Water Works Association and the Water Pollution Control Federation.
   (x)   “Superintendent” shall mean the Superintendent of the Wastewater Treatment Plant of the Village of New Concord or his duly authorized representative.
   (y)   “User Classes” - Each recipient of municipal wastewater treatment services shall be either in the industrial class or the non-industrial class (including domestic, commercial, institutional and governmental). The Industrial Class shall include any non-governmental user as determined by the Board of Trustees, identified in the Standard Industrial Classification Manual of 1972. Office of Management and Budget, as amended and supplemented, under the following divisions: Division A - Agriculture, Forestry and Fishing; Division B - Mining; Division D - Manufacturing; Division E - Transportation, Communications, Electric, Gas and Sanitary Services; and Division I - Services. The Non-Industrial Class shall include all domestic and governmental users and those industrial, commercial and institutional users whose wastes are segregated domestic wastes or wastes from sanitary conveniences where regular domestic wastes are those wastes generated by normal domestic activity as determined by the Board of Public Affairs.
   (z)   “Suspended solids” shall mean solids which either float on the surface of or are in suspension in water, sewage or other liquid and which are removable by laboratory filtration. Their concentration shall be expressed in milligrams per liter. Quantitative determinations shall be made in accordance with procedures set forth in “Standard Methods”.
   (aa)   “Watercourse” shall mean a channel in which a flow of water occurs either continuously or intermittently.
   (bb)   “Service Area” shall mean that area which presently or in the future contributes sewage to the Wastewater Treatment Plant.
   (cc)   “Inflow” shall mean the water discharged into a sewer system, including service connections from such sources as, but not limited to, roof leaders, cellar, yard, and area drains, foundations drains, cooling water discharge, drains from springs and swampy areas, manhole covers, cross connections from storm sewers and combined sewers, catch basins, storm waters, surface runoff, street wash waters, or drainage. Inflow does not include, and is distinguished from, infiltration.
   (dd)   “Shall” is mandatory and “may” is permissable.
   (ee)   Normal Domestic Sewage - Wastewater having the strength and characteristics as that discharged by the average residential user.
   (ff)   NPDES Permit - “National Pollutant Discharge Elimination System” permit shall mean any permit or equivalent document or requirements issued by the State water pollution control agency to regulate the discharge of pollutant.
   (gg)   Surcharge - Charge imposed on users (other than residential) discharging in strength greater than normal domestic sewage.
   (hh)   Debt Service Charge shall mean a charge levied on the users of the sanitary sewer system for the cost of the principal and interest payments on the Village’s share of the wastewater treatment works construction.
   (ii)   Operation and Maintenance shall mean the costs incurred in the act of keeping all facilities for collecting, pumping, treating, and disposing of sewage in a good state of repair and functioning properly, including the replacement of said facilities when necessary.
   (jj)   Replacement shall mean expenditures for obtaining and installing equipment, accessories, and appurtenances which are necessary during the useful life of the treatment works to maintain the capacity and performance for which such works were designed and constructed.
   (kk)   Sewer Service Charges shall mean all charges imposed on users of the sanitary sewage system which includes: operation, maintenance, and replacement of charges (OM&R). Debt Service, and extra-strength surcharges.
   (ll)   User Charges shall means the charge assessed users of the sewage system to recover the cost of OM&R of the sewage collection and sewage treatment system, and the cost for rendering bills and collecting sewer service charges.
   (mm)   User Classes shall mean any class of users of the wastewater works, defined as follows:
      (1)   Residential user shall be any user that discharges waste to the sanitary sewer system from a dwelling unit. A dwelling unit can mean but is not limited to, houses, apartments and mobile homes used primarily for residential occupancy.
      (2)   Industrial user or Industry shall mean any nongovernmental user discharging a trade or process waste to a publicly owned treatment works as identified as a “Division A, B, D, E or I” industry in the Standard Industrial Classification Manual, 1972, Office of Management and Budget, as amended and supplemented. A user in the A, B, D, E or I may be excluded if it is determined that the industry will introduce primarily segregated domestic wastes or wastes from sanitary conveniences.
      (3)   Commercial user shall mean non-residential or non-industrial user that discharges waste to the sanitary sewer system from a commercial establishment. A commercial establishment can mean but is not limited to, retail establishments, service enterprise, and other businesses or community activity.
      (4)   Governmental user shall be a user that discharges from sanitary conveniences to the sanitary sewer system and may mean, but is not limited to, municipal offices, garages, and facilities, and governmental facilities.
      (5)   Institutional user shall mean a user that discharges from sanitary conveniences to the sanitary sewer system and may mean, but it not limited to, hospitals and schools. (Ord. D-12-94-1. Passed 12-12-94.)
