(a) No street trees may be planted closer together than the following: Small trees, 30 feet; medium trees, 40 feet; and large trees, 50 feet; except in special plants designed or approved by the Tree Committee. No trees may be planted closer to any curb or sidewalk than the following: Small trees, 2 feet; medium trees, 3 feet; and large trees, 4 feet. No tree shall be planted closer than 35 feet to any street corner, measured from the point of nearest intersection curbs or curblines. No tree shall be planted closer than 15 feet to any fire hydrant.
(b) No street trees other than those species listed as small trees may be planted under or within 10 lateral feet of any overhead utility wire, or over or within 10 feet of any underground water line, sewer line or other utility.
(c) No person shall maintain, plant, or permit to remain on any private or public premises situated at the intersection of two or more streets in the Village, any tree or other growth which may obstruct the view of the operator of any motor vehicle approaching such intersection to the extent that such operator is unable to observe other vehicles or pedestrians approaching or crossing said intersection. Any such tree or growth is hereby declared to be a public nuisance.
(d) Injury to trees is prohibited. No person shall, without the consent of the owner in the case of a private tree or without a written permit from the Tree Committee in the case of a public tree do, or cause to be done by others, any of the following acts:
(1) Secure, fasten or run any rope, wire, sign, unprotected electrical installation or other device or materials to, around or through a tree.
(2) Break, injure, mutilate, deface, kill or destroy or permit any fire to burn where it will injure any tree.
(3) Permit any toxic chemical, gas, smoke, salt brine, oil or other injurious substance to seep, drain or be emptied upon or about any tree.
(4) Excavate any ditch, tunnel or trench or lay any drive within a radius of 10 feet from any tree.
(5) Erect, alter, repair or raze any building or structure without placing suitable guards around all nearby public trees which may be injured by such operations.
(6) Remove any guard, stake or other device or material intended for the protection of a public tree or close or obstruct any open space about the base of a public tree designed to permit access of air.
