(a) The opening and restoration of pavement or other surfaces, including curb, shall be performed under the direction and satisfaction of the Street Commissioner, and in accordance with rules, regulations and specifications approved by Council. Inspection points/time intervals are contained in the appendix.
(b) Upon failure or refusal of the applicant to satisfactorily fill the excavation, restore the surface or curb and remove all excess materials within the time specified in the permit or where not specified therein within a reasonable time after commencement of the work, the Village may proceed without notice to make such fill and restoration and the deposit referred to in the preceding section shall be deemed forfeited. Thereupon such deposit shall be paid into the street repair fund of the Village, except such part demanded and paid to the applicant as the difference between the deposit and the charges incurred by the Village for restoration services. If the amount of such services performed by the Village should exceed the amount of such deposit, the Clerk shall proceed to collect the remainder due from such applicant.
(c) (1) The edges of all openings through existing pavement shall be straight and the sides vertical. The edges shall also be clean and free of debris as to allow asphalt cements to adhere.
(2) All openings shall be back filled with compacted granular backfill or controlled density fill in maximum of one foot levels.
(3) Main, primary feeder, truck route and all other streets that are bricked or concreted shall be constructed in accordance with Appendix No. 1. A minimum of eight inches of ODOT Item 499, Class C shall be poured to within three inches of the surrounding pavement surface and allowed to cure a minimum of seventy-two hours prior to final surfacing. The final three inches shall be filled with compacted ODOT Item 448 per Appendix No. 1. A seal coat of liquid asphalt shall be applied to the edges of the opening to the bottom of the hole.
(4) Secondary or residential streets and alleys shall be constructed in accordance with Appendix No. 2. A minimum of six inches of ODOT Item 499, Class C shall be poured to within three inches of the surrounding pavement surface and allowed to cure a minimum of seventy-two hours prior to final surfacing. The final three inches shall be filled with compacted ODOT Item 448 per Appendix No. 2. A seal coat of liquid asphalt shall be applied to the edges of the opening to the bottom of the hole.
(5) All parties constructing or restoring streets, alleys or right of ways within the Village shall comply with the foregoing standards. The Street Commissioner shall inspect all closure to determine if the foregoing specifications are met. If the work or materials is found by the Street Commissioner to be substandard, the Street Commissioner shall cause the necessary rework to be done and shall bill the opening party the cost of labor and materials used.
(6) Any shoulder work done to village streets, alleys or right of ways shall be performed in accordance with the ODOT construction and materials specifications manual.
