(a) No person, firm, organization or corporation, either in person or by agent, shall exhibit, have in possession in a place of business, rent, offer for rent or allow to be operated
in his place of business, any pinball machine, skill and amusement machine or any device or machine operated for pleasure or skill, without first having paid to the Mayor, an annual license fee or tax of five dollars ($5.00) for each and every such machine or device so exhibited or offered for rent by such person. For the purpose of this section the license year shall begin with July 1. (Ord. 493. Passed 5-17-48.)
(b) No person shall have, possess or operate in any public place, any juke box, phonograph or other musical instrument operated by mechanical means without first obtaining a license therefor. The cost of such license shall be two dollars ($2.00) per year for each juke box or other instrument operated. (Ord. 494. Passed 6-21-48.)
(c) All machines of whatsoever type or by whatsoever name known, by which the operator may by playing the same, either gain or lose anything of value, are hereby declared to be gambling devices, and the paying of a license fee or tax, under the terms of this chapter, shall in no way be construed to legalize what is otherwise illegal.
