§ 155.36 ADDITIONAL HEIGHT SIGNAGE OVERLAY DISTRICT.
   (A)   General. An additional height signage overlay district providing for and allowing additional height for accessory, commercial, non-accessory and billboard signs located within the additional height overlay district as a “use on review” to accommodate the signage needs in areas adjacent to and near interstate, controlled access highways all pursuant to the following provisions upon review by the Planning Commission and a finding of:
      (1)   The need for the additional height requested;
      (2)   That the placement in relation to the roadway frontage is appropriate; and
      (3)   That the impact of the proposed drainage on other signage in the district, existing and anticipated, will be compatible and complementary to the area and the city the use under these provisions may be recommended to the City Council for approval as “use on review”. Such signs shall conform to the following.
         (a)   Allowable maximum sign height within the district shall be 100 feet.
         (b)   All overheight non-accessory and billboard signage in an overlay district shall be restricted to advertising businesses located in the overlay district.
         (c)   All other provisions of the ordinances of the city shall remain applicable to all signage within an overlay district.
   (B)   District boundaries.
      (1)   I-35 - Highway 9 additional height signage overlay district.
         (a)   From the intersection and off-ramp of I-35 and Highway 9 to a point 660 feet west of Highway 9 and city street, Santa Fe, intersection for a width of 660 feet; and
         (b)   North from Highway 9 along city street, Harvey Street, for a width measured from the I-35 right-of-way to a point 100 feet west of the centerline of Harvey Street.
      (2)   I-44 - Highway 37 additional height signage overlay district.
         (a)   From the I-44 intersection and off- ramp west to a point 330 feet west of Highway 37 and city street, Country Club, intersection for a width of 1,000 feet on either side of Highway 37; and
         (b)   From the I-44 intersection, south along both sides of I-44 and Highway 62 to a point 660 feet south of North 24th Street, for widths described in the following.
            1.   For that portion north of North 24th Street, a width of 150 feet measured from the centerline of the access road right-of-way on either side of I-44 and Highway 62. This measurement description is in anticipation of a west side frontage road right-of-way of 80 feet being acquired by the city and such being equivalent to an overlay width of 230 feet from the existing I-44 right-of-way on the west and from the centerline of Highway 62 on the east.
            2.   For that portion lying south of North 24th Street, the east boundary would be located 150 feet east of the centerline of Highway 62 and the west boundary would extend from the centerline of Highway 62 to the I-44 right-of-way.
