§ 116.11 FIREWORKS STANDS.
   (A)    Fireworks stands shall be at least 50 feet apart and shall not exceed a length of 36 feet, nor a width of eight feet. Stands shall be located a minimum of 50 feet from motor vehicle fuel-dispensing station dispenser; retail propane-dispensing station dispenser; and compressed natural gas dispensing facilities. Stands shall be located a minimum of 300 feet from aboveground storage tanks for flammable or combustible liquids, flammable gas, or flammable liquid gas. Stands shall be constructed of wood or metal or other material approved by the Code Enforcement Officer. Stands must be open to the front and have an exit door either to the rear or on the end. Each stand shall have at least one two and one-half gallon or greater capacity water pump tank and fire extinguisher Type A, B, or C that is approved by a nationally recognized testing organization. The firefighting apparatus shall be maintained in operating condition at all times, and the type and operating capability shall be determined solely by the Fire Department.
   (B)   Retail fireworks stands shall close no later than 10:00 p.m of each day and shall not reopen until 8:00 a.m. of each day. The only periods when stands are permitted to be open for sales are June 15 through July 6 and December 15 through January 2 of each year.
   (C)   A responsible person at least 21 years of age must be in charge of the stand and present at all times it is open for business. Smoking shall be prohibited within 50 feet of any stand, and the permit holder shall display "No Smoking" signs in prominent places on or about the stand.
   (D)   Refuse containers of adequate size and number and with tight-fitting lids must be provided on the premises. All trash, rubbish and debris shall be collected and not become unsightly or blow upon the premises of others.
