§ 116.03 SALE BY NON-PROFIT ORGANIZATIONS.
   (A)   Fireworks may be sold by non-profit service organizations duly operating under the laws of the state which meet weekly or monthly on a regular basis, in the city and are recognized as such by the City Council or the School Board and operating in the city, in accordance with the provisions of this chapter.
   (B)    No person shall sell fireworks at retail within the city, except at stands operated for the purpose and after being issued a permit, as provided herein.
   (C)   Sales at permanent consumer fireworks sales facilities shall be permitted as "retail sales" under the provisions of C-C-2 (Community Commercial District) of the Newcastle Zoning Code and the provisions of this chapter.
