For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
DISCHARGE. The ignition of any fireworks within the city limits of the city, except during a display of fireworks.
DISPLAY. Any public discharge of fireworks pursuant to a permit issued by the city.
FIREWORKS.
(1) Any combustible or explosive composition, or any substance or combination of substances, or articles prepared for the purpose of producing a visible or an audible effect by combustion, explosion, deflagration or detonation, and shall include blank cartridges, toy pistols, toy cannons, toy canes or toy guns in which explosives are used, the type of balloons which require fire underneath to propel the same, firecrackers, torpedoes, skyrockets, Roman candles, sparklers or other devices of like construction and any devices containing any explosive substance.
(2) FIREWORKS shall not include auto flares, paper caps containing not in excess of an average of 0.25 of a grain of explosive content per cap manufacture in accordance with, the department of transportation regulations for packing and shipping as provided therein, and toy pistols, toy canes, toy guns or other devices for use of the caps, the sale and use of which shall be permitted at all times.

Pyrotechnics, special fireworks, shall comply with the applicable provisions of the then-current Fire Prevention Code.
PERMANENT CONSUMER FIREWORKS RETAIL SALES FACILITY. A permanent structure located in the C-C-2 zoning district, complying with requirements of the International Building Code and the International Fire Code and/or codes and standards adopted by the Oklahoma Uniform Building Code Commission and the National Fire Protection Association Standard NFPA 1124 Code for the Manufacture, Transportation, Storage, and Retail Sales of Fireworks and Pyrotechnic Articles, containing consumer fireworks offered for retail sale and open to the public.
RETAIL FIREWORKS STAND. A temporary structure or facility, including a portable building, tent or canopy, that meets flame resistant requirements of the National Fire Protection Association (specifically NFPA701), approved by the city for retail sales of fireworks to the public by non-profit service organizations recognized by the Newcastle City Council or the Newcastle School Board.
