(a) Whoever violates or fails to comply with any of the provisions of this chapter is guilty of a minor misdemeanor and shall be fined not more than one hundred fifty dollars ($150.00) for each offense.
(b) If the offender has been previously convicted of an offense under this section within the past twelve months, then the penalty is a fourth-degree misdemeanor and the offender may be fined not more than two hundred fifty dollars ($250.00) and/or imprisoned not more than thirty days. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
