(a) A grantee shall provide service to all dwelling units and/or commercial subscribers within thirty days of request and, in any additional areas annexed to the City, within six months, in accordance with the line extension standards provided for in subsections (b) through (d) hereof.
(b) A grantee shall provide service to any new residential dwelling units and any additional areas annexed to the City where there are at least twenty-five residential dwelling and commercial subscriber units per proposed cable plant mile.
(c) In other areas with less than twenty-five residential dwelling units and/or commercial subscribers per proposed cable plant mile, a grantee shall offer a cost sharing arrangement with the residents. The cost-sharing arrangement shall consist of the following:
(1) On the request of a potential subscriber desiring service, a grantee shall prepare, at its cost, an engineering survey and cost analysis to determine the cost of plan extension required to provide service to the subscriber from the closest point where available quality signals exist.
(2) The cost of construction shall be allocated based on the following formula: If a request for extension of service into a residential area requires the construction of cable plant which does not pass at least twenty-five potential subscribers per strand or trench mile, a grantee and subscribers will each bear their proportionate share of construction costs. For example, if there are twelve homes per strand mile or trench mile, a grantee and the subscriber will share equally (one-half of the construction cost). The remaining cost will be shared equally by each subscriber. This line extension formula shall also be applied to a portion of a mile meeting proportionate density requirements. After completion of such extension project, should additional subscribers request cable television service, the pro-rata shares shall be recalculated. Each new subscriber shall pay the new pro-rata share and all prior subscribers shall receive pro-rata refunds. At such time as there are twenty-five potential subscribers per mile, the subscribers shall receive their pro-rata share of construction costs. In any event, at the end of three years from the completion of a project, the subscribers are no longer available for refunds, and the amounts paid in construction costs will be credited to the plant account of a grantee.
(3) The average cost of a line extension shall be recalculated annually and shall be based upon then-current costs for labor and materials.
(d) Any person requesting cable service for any dwelling or business other than residential property, or those properties specifically referenced herein, is subject to the current applicable construction costs per outlet, reduced by the time and materials cost typically allocated for a residential installation.
