(a) No person shall enter, without legal justification, upon the premises of another person during a public emergency arising out of a riot, insurrection, invasion, storm, flood or other disaster, or when such premises are damaged by reason of vandalism, riot, insurrection, invasion, fire, explosion, collapse, storm, flood or another disaster.
(b) Whoever violates this section is guilty of a misdemeanor of the first degree and shall be subject to the penalty provided in Section 698.02.
