(a) Any person who violates any provision of this chapter is guilty of a misdemeanor of the third degree. If the offender previously has been convicted of a violation of this chapter within two years of the current offense he or she is guilty of a misdemeanor of the first degree. A person who violates the provisions of this chapter shall be deemed to be guilty of a separate offense for each day, or portion thereof, during which the violation continues.
(b) A violation of any provision of this chapter is declared to be a public nuisance subject to abatement pursuant to City ordinance.
